Can I discuss the project with staff, members of the Planning Board, and <br /> the BOCC? <br /> Yes, you can have discussions with various parties outside of scheduled <br /> meetings/hearings concerning a CZD application. This would not be the case <br /> with an SUP or other quasi-judicial hearings, where the board members are <br /> precluded from deliberations outside the hearing. <br /> 20. Is there a record of the proceedings? <br /> Yes. Minutes from Planning Board and BOCC meetings where a CZD <br /> application is reviewed/discussed/acted upon are maintained by the County. <br /> The Planning Department maintains the application components and become <br /> a part of the file on that case. <br /> 21. What is the effect of a CZD approval? <br /> Per Section 2.9.2 (G) of the UDO, approval of a CZD is binding on the <br /> property. Development and use of the subject parcel(s) is governed by the <br /> submitted/revised application package, the actual ordinance adopted by the <br /> BOCC approving the rezoning request, all conditions imposed as part of the <br /> CZD review process, and the applicable provisions of the UDO. <br /> 22. Are decisions on CZD applications subject to further review? <br /> Yes. Decisions are subject to review by the Superior Court. Per Section <br /> 2.26.5 of the UDO, an appeal to Superior Court must be filled within 60 days <br /> from the date of adoption of the ordinance approving the zoning atlas <br /> amendment. <br />
