2 <br /> As indicated at the December 15 BOCC meeting, staff recommended the imposition of several <br /> conditions designed to address potential impacts of the Project, including: <br /> i. Stormwater: Imposition of a condition that requires the applicant to either: <br /> a. Abide by nutrient reduction strategies as detailed in Section 6.14.7 of the UDO <br /> without participation in the State recognized offsite mitigation program; or <br /> b. Any off-site mitigation has to occur in Orange County near the Property, within the <br /> County's Upper Eno Protected or Critical Watershed Protection Overlay District, to <br /> ensure preservation of local water quality. <br /> ii. Access Management: <br /> a. Driveway access from the Interstate on/off ramp be restricted to two driveways, <br /> one allowing access to the Project east of Mt. Willing Road (i.e. a right turn only <br /> into the Project) and one allowing access to the on/off ramp west of the US <br /> Highway 70/1-85 Connector Road (i.e. a right turn only out of the Project); <br /> Staff has continued to work with the applicant and NCDOT officials to preserve <br /> westbound Exit 160 as being part of a dual westbound exit for both Exit(s) 160 and 161 at <br /> the existing Exit 161 location. <br /> Attachment 2 contains the applicant's response to several recommended condition(s), including: <br /> 1. Alteration of land uses: <br /> a. District 1: Proposed car wash eliminated; <br /> b. Development Area 5: Building square footage reduced from 150,000 to 75,000 <br /> sq.ft.. <br /> 2. Impervious area versus Open Space: <br /> a. Impervious area limited to 60% or approximately 2,718,144 sq.ft. (62.4 acres) of <br /> land area; <br /> b. Open space increased to 40% or approximately 1,812,096 sq.ft. (41.6 acres) of <br /> land area. <br /> 3. Setbacks: Northern boundary property line/land use buffer area increased to 50 ft. as <br /> requested by staff; <br /> 4. Stormwater: <br /> a. Install debris screens on all stormwater inlets to address comment(s) from the Eno <br /> River Association; <br /> b. Nutrient Removal: Project will not exceed: <br /> i. Nitrogen: 1.2 pounds per acre per year; and <br /> ii. Phosphorous: 0.24 pounds per acre per year. <br /> Nutrient export loads are equal to/less than export loads from property in current, <br /> undeveloped state. <br /> 5. Use of Private Mitigation Credits: Consistent with 6.14.7(D) of the UDO applicant shall: <br /> a. Purchase approved `private mitigation bank credits' within the Upper Eno River <br /> Watershed.
