Statement of Consistency indicating the zoning atlas amendment(s) are reasonable <br /> and in the public interest as contained in Attachment 8. <br /> 2. Ordinance amending the Zoning Atlas, as well as imposing development conditions, <br /> for the identified parcels as contained in Attachment 9. <br /> Presuming: <br /> a. BOCC and applicant acceptance of recommended conditions as contained in Attachment <br /> 9; <br /> b. Direction from the BOCC, with the applicants consent as imposition of conditions must be <br /> mutual, on imposition of the following addressing staff concerns on: <br /> i. Stormwater: <br /> Imposition of a condition that requires the applicant to either: <br /> 1. Abide by nutrient reduction strategies as detailed in Section 6.14.7 of <br /> the UDO without participation in the State recognized offsite mitigation <br /> program; or <br /> 2. Any off-site mitigation has to occur in Orange County near the Property, <br /> within the County's Upper Eno Protected or Critical Watershed <br /> Protection Overlay District, to ensure preservation of local water quality. <br /> ii. Access Management: <br /> 1. Driveway access from the Interstate on/off ramp be restricted to 2 <br /> driveways, one allowing access to the Project east of Mt. Willing Road <br /> (i.e. a right turn into the Project only) and one allowing access to the <br /> on/off ramp west of the US Highway 70/1-85 Connector Road (i.e. a right <br /> turn out of the Project only); <br /> Staff shall continue to work with the applicant and NC DOT officials to preserve <br /> westbound Exit 160 as being part of a dual westbound exit for both Exit(s) 160 <br /> and 161 at the existing Exit 161 location. <br /> FINANCIAL IMPACT: This request has been reviewed by various County departments who <br /> have determined that the approval or denial of the request would not create the need for <br /> additional funding for the provision of County services.
