ORANGE COUNTY BOARD OF HEALTH A RESOLUTION CONCERNING THE ADOPTION OF RULES FOR GROUNDWATER PROTECTION AND WELL PERMITTING AND CONSTRUCTION IN ORANGE COUNTY WHEREAS, the Orange County Board of Health is charged with protecting the health, safety, and welfare of all Orange County residents; and WHEREAS, the Orange County Board of Health desires to protect the health of all residents of Orange County from exposure to contaminated groundwater and drinking water, and WHEREAS, wells that are improperly constructed or maintained constitute a significant public health risk for residents living in the County; and WHEREAS, wells that are improperly constructed or maintained may lead to groundwater contamination and detriment of groundwater resources, and WHEREAS, the Orange County Board of Health is enabled by North Carolina General Statute §130A-39 to adopt Rules more stringent than those set forth by the North Carolina Commission for Health Services where, in the opinion of the Orange County Board of Health, a more stringent rule is required to protect the public health; and WHEREAS, it is the opinion of the Orange County Board of Health that these Rules are necessary to ensure the proper construction of wells and protection of the groundwater resources and thereby protect the public health and natural resources of the County; Now, therefore, be it resolved by the Orange County Board of Health that: 1. The Orange County Board of Health has adopted Rules deemed to be more stringent and necessary to protect the public health of citizens in Orange County as contained in the Groundwater Protection Rules for Orange County; and 2. These Rules shall be in full force and effect unless otherwise acted on by the Orange County Board of Health. This day of March 25, 2020.
