ORANGE COUNTY BOARD OF HEALTH <br /> A RESOLUTION CONCERNING THE ADOPTION OF RULES FOR <br /> GROUNDWATER PROTECTION AND WELL PERMITTING AND <br /> CONSTRUCTION IN ORANGE COUNTY <br /> WHEREAS, the Orange County Board of Health is charged with protecting the <br /> health, safety, and welfare of all Orange County residents; and <br /> WHEREAS, the Orange County Board of Health desires to protect the health of all <br /> residents of Orange County from exposure to contaminated groundwater and drinking <br /> water, and <br /> WHEREAS, wells that are improperly constructed or maintained constitute a <br /> significant public health risk for residents living in the County; and <br /> WHEREAS, wells that are improperly constructed or maintained may lead to <br /> groundwater contamination and detriment of groundwater resources, and <br /> WHEREAS, the Orange County Board of Health is enabled by North Carolina <br /> General Statute <br /> §130A-39 to adopt Rules more stringent than those set forth by the North Carolina <br /> Commission for Health Services where, in the opinion of the Orange County Board of <br /> Health, a more stringent rule is required to protect the public health; and <br /> WHEREAS, it is the opinion of the Orange County Board of Health that these Rules <br /> are necessary to ensure the proper construction of wells and protection of the <br /> groundwater resources and thereby protect the public health and natural resources of <br /> the County; <br /> Now, therefore, be it resolved by the Orange County Board of Health that: <br /> 1. The Orange County Board of Health has adopted Rules deemed to be more stringent <br /> and necessary to protect the public health of citizens in Orange County as contained <br /> in the Groundwater Protection Rules for Orange County; and <br /> 2.
