c)The Rules of 15A NCAC 02C .0100 apply to private drinking water wells, as <br /> well as the following: <br /> (1)Potential sources of groundwater contamination shall not be located <br /> closer to the well than the separation distances specified in 15A NCAC <br /> 02C .0107(a) (2)or.0107(a)(3), as applicable; <br /> (2) In addition to the provisions in 15A NCAC 02C .0109, the builder,well <br /> contractor, pump installer, or homeowner, as applicable, shall provide <br /> assistance when necessary to gain access for inspection of the well, <br /> pumps, and pumping equipment; and <br /> (3) In addition to the requirements of 15A NCAC 02C .0113, any well that <br /> acts as a source or channel of contamination shall be repaired or <br /> permanently abandoned within 30 days of receipt of notice from the <br /> Orange County Health Department. <br /> 3.APPLICABILITY—These Rules shall apply to well permits issued after July 1, 2008. comment[vH5]:SAME <br /> Wells constructed pursuant to permits issued prior to July 1, 2008, shall be subject to <br /> these construction standards however the requirement for sampling in NCGS 15A <br /> NCAC 18.3800 shall not apply to those wells. These Rules shall not apply to properly <br /> operating existing wells that are in use on the effective date of these Rules unless <br /> otherwise specified by these Rules. <br /> 4.(COMPLIANCE WITH OTHER LAWS AND REGULATIONS -The provisions of any (Comment[VH6]:SAME <br /> Federal, State, or municipal law or regulation establishing standards affording greater <br /> protection to the public welfare, safety, health and the groundwater resources shall <br /> prevail within the jurisdiction of such agency or municipality over standards <br /> established by these Rules. These Rules shall not release any person,firm, or <br /> corporation from any responsibility as required in 15A NCAC 02C .0100, .0200, and <br /> .0300 (Well Construction Standards)and 15A NCAC 18C (Public Water Supplies). <br /> 5.APPEALS�Appeals concerning permit decisions or actions by Rules by the Orange comment[vH7]:FORMATTING <br /> County Health Department to enforce the rules of this Section, shall be conducted <br /> according to the procedures established in G.S. 150B,the Administrative Procedure <br /> Act and GS130A-24.Appeals concerning the enforcement of Rules adopted by the <br /> Orange County Board of Health and concerning the imposition of administrative <br /> penalties by the Orange County Health Director shall be conducted in accordance <br /> with the Law. <br /> a)The aggrieved person shall give written notice of appeal to the Orange County <br /> Health Director within 30 days of the challenged action. The notice shall contain <br /> the name and address of the aggrieved person, a description of the challenged <br /> action and a statement of the reasons why the challenged action is incorrect. <br /> Upon filing of the notice, the Orange County Health Director shall,within five <br /> working days, transmit to the Orange County Board of Health the notice of appeal <br /> and the papers and materials upon which the challenged action was taken. <br /> b)The Orange County Board of Health shall hold a hearing within 15 days of the <br /> 3 <br />
