3 <br />FINDINGS OF THE ORANGE COUNTY PLANNING BOARD <br />PERTAINING TO <br />APPLICATION: SUP-A-9-01 OLIVE BRANCH INN <br />Special Uses must comply with general and specific standards as set forth in Article 8 for Special Uses. Article 8.2.1 b) <br />requires written findings certifying compliance with the following: <br />(11 Specific regulations governing individual Special Uses as set forth in Article 8.8. These <br />regulations are divided into two 121 sections, which include: <br />(a) Application components; and <br />Ibl Specific standards for Historic Sites -Non-Residential-Reuse/Mixed Use (Article $.8.24 refers to <br />these standards) and Specials Uses (Article 8.2.4-. <br />12- Other requirements as set forth in the Zoning Ordinance, including the provisions of Article 5 <br />(Dimensional Requirements) and Article 6 (Application of Dimensional Requirementsl. <br />Listed below are the findings of the Orange County Planning Department regarding the application in question. The <br />findings have been presented by Article and requirement to assist the Board of County Commissioners in its deliberations. <br />ARTICLE 13,; 2.1 -APPLICATION COMPONENTS ("Yes" indicates compliance;_ "No" indicates non-comvliancel <br />P NNING BOARD <br />FIND <br />Ordinance Requirements <br />8.2.1 The applicant shall have <br />the burden of establishing by <br />competent material and <br />substantial evidence <br />compliance with all required <br />regulations and standards <br />including the following general <br />conditions: <br />1. The use will maintain or <br />promote the public health, <br />safety and general welfare, if <br />located where proposed and <br />developed and operated <br />according to the plan as <br />submitted <br />2. The use will maintain or <br />enhance the value of <br />contiguous property (unless the <br />use is a public necessity, in <br />which case the use need not <br />maintain or enhance the value <br />of contiguous property) <br />3. The use is in compliance <br />with the general plan for the <br />physical development of the <br />County as embodied in these <br />regulations or in the <br />Comprehensive Plan, or portion <br />thereof, adopted by the Board <br />of County Commissioners <br />Yes ' _ No <br />~( Yes .~ No <br />X Yes ' _ No <br />EVJDENCE SUBMITTED_TO BOCC <br />SUPPORT FINDINGS FINDINGS <br />Based on comments from the <br />Fire Marshal, NCDOT, and <br />Environmental Health, the use <br />will maintain or promote the <br />public health safety and general <br />welfare. <br />Testimony by Michael Howard, <br />Real Estate Appraiser, indicated <br />that this use will maintain or <br />enhance the value of <br />contiguous property. <br />A Bed & Breakfast is allowed in <br />this zoning district IR11 <br />provided that all Class A SUP <br />criteria are met.
