2 <br />the eastern side of the right-of-way to NCDOT or Orange County prior to commencing <br />operation. . <br />• Applicant considers right-of--way dedication requirement too rigorous for three-room <br />guest establishment and stated that it should not be a condition of approval of the SUP. <br />(Applicant's responses to all eight conditions are enclosed as an attachment) <br />Information/Issues at the Plannin Board Meetin on Jul 11 2001 <br />• The solar light recommendation at the Public Hearing was discussed at the Planning Board <br />meeting. The Planning Board recommended eliminating the solar lighting requirement <br />based on limited, unreliable technology existing at this time. (Condition # 6) <br />• The'Planning Board recommended eliminating the fee simple right-of--way dedication <br />condition. (Condition # 7) <br />• The Land Use Buffer requirement along NC Hwy 57. <br />• Planning Board recommended that the Planning Director consider a complete waiver of <br />the landscape requirement instead of a partial waiver, as provided for in Section 12.8 of <br />the Zoning Ordinance. <br />Dev to ment Pro Schedule Actio <br />1) Public Hearing on May 29, 2001. <br />• Historic Preservation Commission reviewed Special Use Permit on June 27, 2001 and <br />determined that proposed use maintains the historic character of the house and property <br />as required in Section 8.8.24.2 b) of the Orange County Zoning Ordinance. <br />2) Planning Board voted (10-0) to approve the Class A Special Use Permit on July 11, 2001, <br />eliminating conditions #6 and #7 as shown on the Planning Board recommendation. <br />3) BOCC to make final decision. <br />FINANCIAL IMPACT: No fiscal impact is associated with this decision. <br />RECOMMENDATION(S): Administration. Re~ommendatioR: <br />The Administration recommends approval of the Class A Special <br />Use Permit in accordance with the attached Administration <br />Resolution. (See Page 31) <br />(The three issues that were raised at the Planning Board meeting have <br />been addressed in the following manner. <br />1) The Administration recommends retaining the solar-powered light <br />requirement far the en#rence sign, <br />2) deleting the fee simple dedication of right-of-way, and <br />3) the Planning Director agrees to waive the standard land use buffer <br />requirement along NC Hwy 57. The Planning Director, furthermore, <br />encourages the maintenance and eventual replanting of the existing oaks <br />in front of the house to ensure the site's future rural character.) <br />
