<br />7 <br /> <br />3. Public Participation <br />3.1 Was the public notified and included in the review process for the proposed RTLP MPD- <br />CZ? <br />Yes. Throughout the planning review process, Orange County residents have been included and <br />welcomed to voice their concerns and provide comments. Public notifications were provided as required <br />by State Law and the Orange County Unified Development Ordinance. The table below details public <br />notification and participation throughout the process. In addition, the third column in green illustrates <br />Orange County requirements for rezoning requests which exceed State law requirements. Throughout <br />the process Orange County staff has operated transparently and communicated with residents via email <br />and phone. <br />Public Notification Requirements for Rezoning Applications: RTLP <br /> State Requirements <br />(NC GS 153A-343) <br />Orange County Requirements <br />(Unified Development Ordinance) RTLP Project <br />Neighborhood <br />Information <br />Meeting <br />(NIM) <br />- Not a required process <br />- A Neighborhood Information <br />Meeting doesn’t involve a public <br />body, so notice requirements under <br />the Open Meetings law do not <br />apply. <br />- Required per UDO Sec. 2.9.2 (D) <br />- Applicant must mail notices to each <br />property owner within 1,000 ft. of the <br />subject property <br /> - Notice must include date and time of <br />NIM <br />- Notice must be mailed at least 14 days <br />prior to NIM <br />- Applicant must post a sign on the <br />subject property at least 10 days prior to <br />NIM <br />- On June 30, 2020, the applicant <br />mailed out meeting notices to <br />property owners within 1,000 ft. of <br />the RTLP parcels. <br />- On June 30, 2020, Planning staff <br />posted meeting notice signs on the <br />subject parcels. The signs included <br />specific project details in keeping <br />with a previous request from the <br />BOCC regarding notification signs. <br />- On July 15, 2020, the applicant <br />hosted a virtual Neighborhood <br />Information Meeting. <br />Planning <br />Board <br />Review <br />- State law does not require the <br />Planning Board to receive public <br />comments. <br />- Notification of any meeting of the <br />Planning Board for business must <br />follow NC GS § 143-318.12, Public <br />Notice of Official Meetings. <br />-The statute does not require <br />sending meeting notices to <br />individual property owners. <br />- The County must keep the Board’s <br />regular meeting schedule on file <br />with the Clerk to the BOCC and on <br />the website. If the Board is to hold <br />an official meeting at a different <br />time or place than previously <br />scheduled, public notice is <br />required. <br />- Public comment accepted per UDO Sec. <br />2.8.8 (A). <br />- Same notification requirements as for <br />the public hearing per UDO Sec. 2.8.7. <br />See below. <br />- The Planning Board held two <br />meetings (August 5th and August <br />19th). <br />- Meeting notices were mailed on <br />July 20th and the notification sign <br />was posted on July 24th. <br />- The Planning Board announced in <br />open session at the August 5th <br />meeting that the meeting would <br />continue on August 19th at 7 pm. As <br />such, re-advertising was not <br />required per NC GS § 143-318.12 <br />(b) (1). <br />- All public comments provided to <br />Orange County Planning staff prior <br />to commencement of the August 19 <br />meeting were compiled and made <br />available to the Planning Board. <br />BOCC <br />Hearing <br />- The following notifications must <br />occur between 10-25 days before <br />the hearing. <br />- Mail hearing notices via first class <br />mail to abutting property owners. <br />- Post a hearing notice sign on the <br />subject parcels. <br />- The following notifications must occur <br />between 10-25 days before the hearing: <br />- Mail notices via first class mail to <br />property owners within 1,000 ft. of the <br />proposed rezoning and via certified mail <br />to the owner of the subject property. <br />- This FAQ document was produced <br />before public hearing notices were <br />due to be mailed.
