22 <br /> 1 Whereas, the Ordinance specifically sets forth materials that are not to be brought to the <br /> 2 Orange County convenience centers, now referred to as the Waste and Recycling Centers (the <br /> 3 Centers), and <br /> 4 <br /> 5 Whereas, the Ordinance specifically provides that Construction and Demolition Waste is not <br /> 6 allowed at the Centers, and <br /> 7 <br /> 8 Whereas, the Board has determined that it is in the interests of the County to allow limited <br /> 9 amounts of residential Construction and Demolition Waste to be deposited at the Centers by <br /> 10 Orange County residential users; and <br /> 11 <br /> 12 Whereas, there is also one provision in the Ordinance that related to the MSW landfill that was <br /> 13 closed in 2013 and is no longer relevant. <br /> 14 <br /> 15 NOW, therefore be it ordained that the Code of Ordinances, Orange County, North Carolina, <br /> 16 Chapter 34, is hereby amended in section 34-40 thereof to read as set forth on the attachment <br /> 17 hereto. <br /> 18 <br /> 19 This Amendment shall become effective on August 3, 2020. <br /> 20 <br /> 21 Adopted by the Orange County Board of Commissioners this day of June, 2020. <br /> 22 <br /> 23 A motion was made by Commissioner Marcoplos, seconded by Commissioner Dorosin <br /> 24 for the Board to: <br /> 25 <br /> 26 1) approve the attached proposed resolution amending the Solid Waste Ordinance with <br /> 27 the amendments becoming effective August 3, 2020; <br /> 28 2) direct solid waste staff to consistently enforce Section 34-40 of the Solid Waste <br /> 29 Ordinance related to construction and demolition waste as set forth in the amended <br /> 30 Ordinance beginning August 3, 2020; and <br /> 31 3) in the interim, pursue a public education effort to inform the public and also make <br /> 32 signage improvements at the various Centers to educate the public and enhance <br /> 33 administration of the Ordinance provisions. <br /> 34 <br /> 35 Commissioner McKee offered a non-friendly amendment to change the 36 feet to 60 <br /> 36 cubic feet. <br /> 37 Commissioner Price seconded. <br /> 38 Commissioner Price said initially she had no qualms with this as written, but <br /> 39 Commissioner McKee has used SWCC for years, and she respects his comments and input on <br /> 40 what is most reasonable to for those who regularly use SWCCs. <br /> 41 Commissioner Greene asked if the resolution includes a provision to review the issue in <br /> 42 a year's time. <br /> 43 Chair Rich said it is not in there. <br /> 44 Commissioner McKee said he would accept Commissioner Greene's suggestion to re- <br /> 45 evaluate the matter after a year. <br /> 46 Commissioner Price agreed. <br /> 47 Commissioner Marcoplos said he has been using these same SWCC dumpsters for <br /> 48 years, which informed his motion as well. <br /> 49 Commissioner Greene said the current practice has been 120 cubit feet, and 60 cubic <br /> 50 feet seems a more reasonable reduction than 36 cubic feet. <br />
