Since approval, <br />no development activity has occurred. <br /> <br />ISSUE: The County has been approached by a developer proposing a new MPD-CZ district <br />involving the 2 parcels within ‘District 1’ as well as a 12 acre parcel with frontage on Davis Road. <br />Staff has determined the 8 parcels in ‘District 2’ will have great difficulty complying with the MPD-CZ <br />development standards with the elimination of the 2 parcels in District 1. In order to ensure the 8 <br />parcels have development potential, staff has determined they need to be rezoned and is proposing <br />the following: <br />1. If approved, development of these properties will be regulated <br />consistent with the provisions of the Unified Development Ordinance (UDO) rather than the various <br />conditions associated with the approval of the MPD-CZ for Settlers Point. <br /> <br />Analysis: As required under Section 2.8.5 of the UDO, the Planning Director is required to: ‘cause <br />an analysis to be made of the application’ and pass that analysis on to the reviewing body. In <br />analyzing this proposal, the Planning Director offers the following: <br />1. The proposal is consistent with goals/policies outlined within the Comprehensive Plan <br />concerning development, including: <br />a. Land Use Overarching Goal: Coordination of the amount, location, pattern, and <br />designation of future land uses, with availability of County services and facilities <br />sufficient to meet the needs of Orange County’s population and economy consistent <br />with other Comprehensive Plan element goals and objectives. <br />b. Land Use Goal 2: Land uses that are appropriate to on-site environmental conditions <br />and features and that protect natural resources, cultural resources, and community <br />character. <br />19
