Staff is unsure how such a condition would be enforced in the event of a <br />complaint. <br />8. A condition was recommended that all structures erected within the project be designed <br />to accommodate alternative energy devices (i.e. solar panels, etc.); <br />STAFF COMMENT: The applicant agreed to a condition indicating building design <br />would not preclude incorporation of alternative energy systems. <br />9. A condition was recommended that no fuel/chemical storage occur near the floodplain. <br />STAFF COMMENT: Current regulations (Section(s) 6.13 and 6.21 of the UDO) <br />prohibit the storage of chemicals within the floodplain or floodplain buffer. The <br />applicant indicated their willingness to impose an additional 30 ft. setback from the <br />edge of the required floodplain/stream buffers related to the storage of <br />fuel/chemicals. <br /> <br />Planning Director’s Recommendation: The Planning Director continues to recommend approval <br />of the: <br />1. Statement of Consistency indicating the zoning atlas amendment(s) are reasonable <br />and in the public interest as contained in Attachment 5. <br />2. Ordinance amending the Zoning Atlas, as well as imposing development conditions, <br />for the identified parcels as contained in Attachment 6. <br /> <br />FINANCIAL IMPACT: This request has been reviewed by various County departments who <br />have determined that the approval or denial of the request would not create the need for <br />additional funding for the provision of County services. C osts associated with advertising, <br />including the public hearing notice and mailings, were paid by the applicant in accordance with <br />the adopted Orange County Fee Schedule. <br /> <br />RECOMMENDATION: The Planning Director recommends the Board: <br /> <br />1. Continue deliberation on the proposal, <br />2. Consider the Planning Director’s recommendation, <br />3. Vote on the imposition of conditions, as detailed herein, and <br />4. Make a recommendation to the BOCC on the Statement of Consistency (Attachment 5) <br />and the proposed ordinance (Attachment 6) in time for the September 15, 2020 BOCC <br />meeting. <br /> <br />41
