9 <br /> Attachment C <br /> STATE OF NORTH CAROLINA <br /> ORANGE COUNTY <br /> AMENDMENT TO SCHOOLS ADEQUATE PUBLIC <br /> FACILITIES MEMORANDUM OF UNDERSTANDING <br /> The Orange County Board of Education,hereinafter referred to as"School District,"Town <br /> of Hillsborough and Orange County agree to the following amendment to the Schools Adequate <br /> Public Facilities Memorandum of Understanding made and entered into between the parties on the <br /> 17th day of July 2003 (the "MOU"): <br /> WHEREAS, the School District serves pre-kindergarten students in its schools; <br /> WHEREAS, the pre-kindergarten students increase the number of students attending the <br /> schools; <br /> WHEREAS, the School District, Town of Hillsborough and Orange County support the <br /> continued education of pre-kindergarten students in the School District and therefore agree to <br /> amend the MOU to expressly include the pre-kindergarten students in the student membership <br /> calculations established in the MOU; and <br /> THEREFORE, Section l.a. will be replaced to state as follows: <br /> "For purposes of this Memorandum, the term "school membership" means the <br /> actual number of students attending school as of November 15 of each year. <br /> The figure is determined by considering the number of students enrolled (i.e. <br /> registered, regardless of whether a student is no longer attending school), <br /> including students enrolled in each school's pre-kindergarten classrooms, and <br /> making adjustments for withdrawals, dropouts, deaths, retentions and <br /> promotions. Students who are merely absent from class on the date membership <br /> is determined as a result of sickness or some other temporary reason are <br /> included in school' membership figures. Each year the School District shall <br /> transmit its school membership to the parties to this agreement no later than five <br /> (5) school days after November 15. Within fifteen (15) school days after <br /> receiving the school membership calculations from the School District, the <br /> Board of County Commissioners shall approve the School District's school <br /> membership calculations." <br /> MOU Otherwise Unchanged. The parties agree that in all other respects, except as <br /> specifically amended by this document, the MOU remains unchanged and all of its terms remain <br /> in full force and effect between the parties. <br />
