39 <br /> RES-2020-027 Attachment 4 <br /> ORANGE COUNTY BOARD OF COMMISSIONERS <br /> RESOLUTION LEASING PROPERTY UP TO TEN YEARS <br /> Whereas, Orange County owns the Orange County Sportsplex, located at 101 <br /> Meadowlands Drive, Hillsborough, NC 27278, comprising approximately 80,903 <br /> conditioned square feet (the "Premises"); and <br /> Whereas, Cellco Partnership (dba Verizon Wireless) desires to lease certain space on <br /> the wall and roof of Sportsplex located at 101 Meadowlands Drive, Hillsborough, Orange <br /> County, North Carolina, for the installation, operation and maintenance of communications <br /> equipment; and <br /> Whereas, Cellco Partnership will pay an annual rent of $1,800 over the course of an <br /> initial 5 year term with automatic renewal for one five (5) year term; and <br /> Whereas, North Carolina General Statute 160A-272 authorizes the lease of county- <br /> owned properties for terms of up to ten years upon resolution of the Board of <br /> Commissioners at a regular meeting after thirty days' public notice; and <br /> Whereas, in consideration of the annual rent and improved cell service to nearby <br /> residents that will be provided by the addition of a cell tower, including those using the <br /> County's Sportsplex and Passmore facilities, the Board of Orange County <br /> Commissioners desires to lease the necessary space to Verizon Wireless, the required <br /> notice has been published and the Board of Commissioners is convened at a regular <br /> meeting; <br /> NOW THEREFORE BE IT RESOLVED, that the Board of Orange County <br /> Commissioners hereby approves the lease of the County property described above to <br /> Cellco Partnership, for a term of five years commencing May 1st, 2020 with automatic <br /> renewal for up to one five (5) year term, ratifies the signed lease, and directs the <br /> execution, registration, and filing of all necessary instruments accordingly. <br /> This the 21 st Day of April 2020. <br /> Penny Rich, Chair <br /> Orange County Board of Commissioners <br />
