REQUIREMENT UDO SUPPORTING EVIDENCE Staff BOA <br />FINDINGS: <br />In accordance with Section 2.10.3 of the UDO, the Board of Adjustment shall also consider the following before <br />the application for a VARIANCE can be approved. <br />Unnecessary hardship would <br />result from the strict application <br />of the Ordinance. It shall not be <br />necessary to demonstrate that, <br />in the absence of the variance, <br />no reasonable use can be made <br />of the property. <br />Sec 2.10.3 (A) Application package inclusive <br />including: <br />1. Exhibit 10 proposed plot <br />plan <br />The location of the existing <br />septic system limits potential <br />areas allowing for the re- <br />development of the property. <br />The location of the McCauley <br />Lane right-of-way also restricts <br />locations where a new residence <br />can be located. The topography <br />of the lot does not lend itself to <br />the house being further from <br />McCauley Lane or the septic <br />system without creating <br />additional compliance issues <br />with land use and environmental <br />health regulations. <br />Staff <br />agrees. <br />The hardship results from <br />conditions that are peculiar to <br />the property, such as location, <br />size, or topography. Hardships <br />resulting from personal <br />circumstances, as well as <br />hardships resulting from <br />conditions that are common to <br />the neighborhood or general <br />public, may not be the basis for <br />granting a variance. <br />Sec 2.10.3 (B) Application package inclusive <br />including: <br />1.
