Box 8181 <br />Hillsborough, NC 27278 <br />January 30, 2020 <br />RE: NOTICE OF BOARD OF ADJUSTMENT QUASI-JUDICIAL PUBLIC HEARING <br />REVIEW OF A VARIANCE REQUEST <br />2902 Neville Road (PIN: 9759-90-1519). <br />To Whom It May Concern: <br />You are receiving this letter because you are listed as an owner of property within 1,000 <br />feet of a parcel of property with a physical street address of 2902 Neville Road within the Chapel <br />Hill Township of Orange County. <br />The parcel, further identified utilizing Orange County Parcel Identification Number (PIN) <br />9759-90-1519, is approximately 2.2 acres (95,832 sq.ft.) in area and is zoned Rural Buffer (RB) <br />University Lake Protected Watershed Protection Overlay District. The parcel has frontage on two <br />roadways, specifically Neville Road (SR 1945) and McCauley Lane, a privately maintained <br />roadway (hereafter ‘the property’). <br />Development(s) within the RB general use zoning district are required under the provisions <br />of the Orange County Unified Development Ordinance (UDO) to adhere to a building setback of <br />40 ft. from road rights-of-way (public or private). <br />The property owner, MICHAEL WADE CHRISTOPHER and SARA DANIELLE KECK <br />(hereafter ‘the applicant’), have applied for a VARIANCE from the 40 ft. front yard/corner lot <br />setback standards of the RB general use zoning district. Specifically, the applicant is requesting a <br />20 ft. reduction from the 40 ft. required setback off of the McCauley Lane right-of-way (i.e. <br />observing a 20 ft. setback from the McCauley Lane right-of-way). If approved, a structure will be <br />allowed to be 20 ft. from the edge of the McCauley Lane right-of-way versus the typically required <br />40 ft. setback per Section 3.3 of the UDO. <br />The applicant is proposing to construct a new single-family residence on the property, <br />making use of an existing septic system. The applicant argues they cannot comply with both the <br />required 40 ft. setback from the McCauley Lane right-of-way and the required setback from the <br />existing septic system as enforced by the Orange County Environmental Health – Well and Septic <br />division. The applicant further argues the topography of the lot limits viable location(s) for the <br />residence without creating compliance issues with land use regulations and Environmental Health <br />standards. <br />A copy of the site plan denoting the issue is attached for your edification. <br />UDO Section 2.10 requires that the Board of Adjustment (BOA) hold a Public Hearing on <br />variance requests and that notices be sent to property owners within 1,000 feet of the subject <br />
