UDO the Board chair reserves the right to exclude evidence and testimony that <br />is deemed: ‘incompetent, irrelevant, immaterial, or unduly repetitious’ and <br />therefore fails to reasonably address the issues before the Board of <br />Adjustment. While it should be noted there is no time limit on the <br />presentation of evidence, the Chair asks that the presentation of evidence be <br />consistent with established policies, rules of procedure, and acceptable <br />levels of decorum to ensure a fair and equitable hearing for all parties. <br />No. Page(s) Agenda Item <br />5. CASES: <br />1.A-1-20 –Quasi-judicial hearing to review a Variance Application <br />requesting a 20’ reduction to the required front building setback from <br />the McCauley Lane right-of-way. <br />In accordance with UDO Sections 2.10 Variances and 3.3 Residential <br />Districts, the property owners have submitted this variance request for <br />their parcel of property, which is further described as follows: <br />x Parcel Identification Number (Orange County):9759-90-1519 <br />x Acreage:2.21 acres <br />x Zoning District: Rural Buffer <br />x Watershed Designation: University Lake Protected Watershed <br />The applicants are requesting a 20 ft. variance from the normally required <br />40 ft. front yard setback. If approved, a structure will be allowed to be 20 <br />ft. from the edge of the McCauley Lane right-of-way versus the typically <br />required 40 ft. front yard setback per Section 3.3 of the UDO. <br />The applicants argue the existing road right-of-way, and location of the <br />necessary septic system, prevent them from complying with the required <br />40 ft. front yard setback. The topography of the lot also limits their options <br />with respect to where the proposed residence can be located and still <br />conform with applicable land use regulations and Environmental Health <br />standards with respect to the location of the required septic system. <br />2.A-2-20 –Evidentiary hearing to review a Class B Special Use Permit <br />application for a recreational facility on Atkins Road in the Cedar <br />Grove Township. <br />In accordance with UDO Sections 2.7 Special Use Permits, 5.2 Table of <br />Permitted Uses, 5.3.2 Special Uses, and 5.7.2 Recreational Facilities, the <br />applicants have submitted a Class B Special Use Permit (SUP) application <br />for a parcel on Atkins Road, which is further described as follows: <br />x Parcel Identification Number:9829-93-4847 <br />x Acreage:68.78 acres <br />x Zoning District:Agricultural Residential (AR) <br />x Watershed Designation:Back Creek Protected <br />The applicants are proposing an outdoor recreational facility for lacrosse <br />league practice and tournaments. If approved, the facility will include the <br />following features: <br />
