3 <br /> C . Reservation of land -- developer sets aside land for future <br /> purchase by a governmental agency <br /> 1 . As a condition of subdivision plat approval <br /> City : Ordinance " may provide . . . for the . . . reservation of <br /> recreation areas serving residents of the immediate <br /> neighborhood within the subdivision " <br /> County : Same <br /> 2 . Statute does not provide for how long reservaton may <br /> remain in effect or what evidence the local unit must <br /> provide to demonstrate that the parcel will eventually <br /> be purchased . <br /> D . Impact fees -- developer pays fee representing pro - rated cost of <br /> providing community-wide and area -wide recreational facilities <br /> required by the new development <br /> 1 . No express statewide authorizing legislation presently exists <br /> for impact fees to finance park , recreation areas , or open <br /> space <br /> 2 . Fees must be spent in timely manner and to provide <br /> facilities that sufficiently benefit those who reside or <br /> occupy the development for which they were paid . <br /> E . Setbacks , buffers , and density transfers ordinance requires <br /> landowner to comply with standards in zoning or land <br /> subdivision ordinance <br /> 1 . Linear buffers may be required for various natural resource , <br /> hazard , and land use protection purposes . <br /> 2 . Development potential within buffer can be transferred to . <br /> other portions of adjacent property . <br /> 3 . However , development restrictions of this type do not <br /> necessarily open up areas to public access . <br />
