r - _ w <br />From: Orange County Subdivision Regulations <br />..~- .~.. <br />': ~ ,. <br />IV-B-7. SITES FOR PUBLIC USE <br />IV-B-7-a. School Sites <br />*IV-S-7-a-1. Applicability <br />*Amended In every subdivision, school sites may be reserved in <br />8-4-86 accordance with the adopted Comprehensive Plan for <br />4-4-88 Orange County. For authorization to reserve school <br />sites to be effective, the Board of Commissioners, prior <br />to the adoption of the Comprehensive Plan or any <br />amendment thereto, shall have jointly determined with <br />the Board of Education having jurisdiction over the <br />area, the specific location, size and suitability of <br />each school site to be reserved. All sites so <br />designated shall appear in the adopted Comprehensive <br />Plan. <br />*IV-B-7-a-2. Method of Reservation <br />*Amended Whenever a subdivision which includes part of all of a <br />e-4-86 school site to be reserved is submitted for approval, <br />the Planning Board and the Board of Commissioners shall <br />immediately notify the Board of Education having <br />jurisdiction over the area. The Board of Education <br />shall promptly decide whether it wishes the site to be <br />reserved and shall notify the Planning Board and Board <br />of Commissioners of its decision. If the Board of <br />Education does not wish the site to be reserved, no site <br />may be reserved. If the Board of Education does wish <br />the site to be reserved, the subdivision may not be <br />approved without the reservation and without the school <br />site being designated on the subdivision plat as such. <br />The Board of Education must acqua.re the school site <br />either by purchase or by exercise of the power of <br />eminent domain within eighteen (18) months after the <br />date the site is reserved. If the Board of Education <br />has not purchased the site or begun proceedings to <br />condemn the site within the eighteen (18) months, the <br />subdivider may treat the land as freed of the <br />reservation. <br />-35- <br />
