These 24 <br />amendments are scheduled for Planning Board recommendation on December 4, 2019 and for BOCC public hearing 25 <br />on January 21, 2020 26 <br />27 <br />PRESENTER:Michael Harvey, Current Planning Supervisor28 <br />29 <br />Michael Harvey reviewed the proposed amendments to the UDO and provided background information. 30 <br />31 <br />Hunter Spitzer: After the permits are issued, what is the staff’s and County’s responsibilities?32 <br />33 <br />Michael Harvey: Our responsibility is to continue to inspect the sites, in some cases, on a weekly basis to ensure 34 <br />compliance to the erosion control plan.35 <br />36 <br />Hunter Spitzer: That is spelled out on a permit by permit basis?37 <br />38 <br />Michael Harvey: Yes, and no it’s not the same per permit. It depends on the nature of the development.39 <br />40 <br />Hunter Spitzer: I have a comment about the consideration of past performance.41 <br />42 <br />Michael Harvey: That’s a state rule but I’d like to hear your comment43 <br />44 <br />Hunter Spitzer: So the state rule is that an applicant’s record may be considered for up to two years prior to the 45 <br />application date, it seems that if we are extending the erosion control, we would extend that as well – to five years.46 <br />47 <br />Michael Harvey: We can look into that but I think I am going to be pretty limited. As a reminder, we will have to 48 <br />submit this ordinance package to the state for approval. They don’t allow us to operate carte blanche – we are a 49 <br />locally delegated program but we do have a tight leash. I can look into the past performance issue.50 <br />51 <br />52 <br /> 9
