21 33. Any headings preceding the text of the several Articles and Subparagraphs hereof are inserted solely for convenience and reference and shall not constitute a part of this Lease Agreement, nor shall they affect is meanings, construction or effect. TIME 34. Time is of the essence in this Agreement. Whenever a period of time is herein prescribed for action to be taken by Landlord or Tenant, or whenever a date for completion of such action is specified herein, Landlord or Tenant shall not be liable or responsible for, and there shall be excluded from the computation of any such period of time, (or such date shall be extended for a period equal to, as the case may be), any delays due to war, civil commotion, acts of God, strikes or other labor disputes, governmental restrictions or regulations or interference, fire or other casualties, or any other causes of any kind whatsoever which are beyond the reasonable control of Landlord or Tenant, as the case may be. MEMORANDUM OF LEASE 35. Tenant and Landlord shall execute and record a Memorandum of Short Form of Lease, but said Memorandum of Short Form of Lease shall not be deemed to modify, change or affect any provision of this Lease in any manner whatsoever. ENTIRE AGREEMENT 36. This Lease Agreement, with the Exhibits attached hereto, contains all of the agreements and conditions made between the parties hereto and may not be modified orally, or in any manner other than by agreement, in writing, signed by the parties hereto or their respective successors in interest. LEASE INURES TO THE BENEFIT OF THE ASSIGNEES 37. This Lease and all the covenants, provisions and conditions contained herein shall inure to the benefit of and be binding upon the heirs,personal representatives, successors and assignees, respectively of the parties hereto.
