Open <br />Spao~Cluster Provision). <br />BACKGROUND: The Orange County Board of County Commissioners, on October 10, <br />2000, adopted amendments to the Orange County Subdivision Regulations regarding private <br />roads. The Board included six items same which were addressed in the amended <br />regulations: <br />1) a declarative statement on page 18 as follows: "There is no right to a private road in any <br />subdivision larger than three lots." <br />2) Three-lot subdivisions would not require engineer certification; <br />3) Three-lot subdivisions can ask for aone-year extension for minor subdivision approval <br />after the one-year expiration; <br />4) The amendments will be reviewed in two years or less; <br />5) No more than 12 lots will be permitted on a private road; and <br />6) A sliding scale of lot sizes will be provided for subdivisions with at least 50% open space." <br />These items are acknowledged by the Board in the following three manners: <br />FOR INFORMATION ONLY <br />• Items 1, 2, 4, and 5 are included in the attached Ordinance Amending the Orange County <br />Subdivision Regulations, adopted October 10, 2000 (beginning on page 3.) <br />RETURN TO MAY 2001 PUBLIC HEARING <br />• Item 3 was not included in amendments presented at the public hearing in February 2000 <br />therefore it could not be added at this time. As the minor plat time limit is presently <br />written, there is no limit, so the intent of the board to be more liberal than staff has <br />
