landmark, the report can be used to promote the property ' s importance to the community, to <br /> evaluate proposed alterations , and to defend the HPC ' s decisions against legal challenges . <br /> National Register Research Reports Funded By the Property Owner . Owners of NRSL <br /> properties may elect to pursue the National Register nomination report on their own to <br /> avoid waiting for selection from the priority list. If an owner wishes to pay for the study, <br /> he/she should employ an experienced hist <br /> oric preservation consultant approved by the i <br /> SHPO . These privately-funded studies will not be subject to reimbursement when the <br /> property is selected as a designation priority by the HPC . If the study determines the <br /> property to be National Register- eligible, the HPC will, at the owner ' s request, consider a <br /> local designation recommendation apart from the priority list process . <br /> For properties already listed on the National Register of Historic Places , a research report <br /> will not be necessary . The HPC can recommend landmark designation of these sites <br /> based on their National Register status . By virtue of its listing on the National Register, <br /> ificance of the property is unquestioned. However, the HPC must still determine the sign <br /> if a National Register property has undergone any changes since its date of listing that <br /> ficance . In such cases , the HPC may decline to recommend <br /> may have lessened its signi <br /> the property for local landmark status . ' <br /> Submission of Report to the State Historic Preservation Office . The research report must be <br /> submitted to the State Historic Preservation Office upon completion. If a property is <br /> already listed on the National Register of Historic Places , the National Register nomination, <br /> with a cover sheet, can serve as the required report. The SHPO must be given the <br /> opportunity to review the report and to comment on the property ' s worthiness for <br /> designation. This review is intended as a way for the SHPO to provide technical assistance <br /> and support to local preservation commissions . The SHPO report is for the consideration of <br /> the HPC and Board of Commissioners . It is not binding, and if SHPO has not commented <br /> on the report within thirty days of receipt, the local government is relieved of the <br /> responsibility to consider such comments . Review and comment by the SHPO will occur <br /> prior to the HPC ' s recommendation to the Board of Commissioners . <br /> The Desi nation Procedure. Article 3 of the Historic Preservation Ordinance outlines'ry n the <br /> specific steps for landmark designation status . Landmarks are officially designated upon <br /> adoption of an ordinance by the Orange County Board of Commissioners . <br /> After the receipt of comments on the designation report from the State Historic Preservation <br /> Office, the HPC may recommend to the Board of Commissioners that a property be <br /> designated as a historic landmark. e HPC will submit the designatio <br /> n on report, the SHPO <br /> comments , minutes of the meeting at which the designation was considered, and a proposed <br /> ' A procedure exists whereby a site can be removed from the National Register of Historic Places if <br /> changes have occurred that cause it to lose its significance . However, this is a complicated, rarely-used <br /> process requiring the involvement of the State Historic Preservation Office and the National Park Service ; <br /> therefore , it will not be explained in this report . <br /> 3 - 7 <br />
