Orange County ABC Board Policy and Procedure Manual <br /> Medical Leave <br /> Overview: The Family and Medical Leave Act(FMLA) went into effect in 1993. Under FMLA, <br /> employees who qualify are granted leave for certain family-related events and illnesses. <br /> Family Leave mainly pertains to an employee's family; whereas, Medical Leave pertains to <br /> the employee themselves. <br /> Employees Eligible for Medical Leave: In general, to be covered, an employee must be a <br /> regular full-time employee and must have worked for at least 12 months and must have <br /> performed at least 1,250 hours of work (approximately 25 hours per week) during the 12 <br /> months before leave begins. There are also some other qualifications that must be met. <br /> Employees Considering Medical Leave: The information contained in this manual is not all <br /> inclusive or exhaustive. Additional information should be requested from management and <br /> additional sources to ensure a particular situation qualifies for FMLA treatment. <br /> The Board provides leaves of absence without pay to eligible employees who are <br /> temporarily unable to work due to a serious health condition or disability. For purposes of <br /> this policy, serious health conditions or disabilities include inpatient care in a hospital, <br /> hospice, or residential medical care facility; continuing treatment by a health rare provider; <br /> and temporary disabilities associated with pregnancy, childbirth, and related medical <br /> conditions. <br /> Eligible employees should make requests for medical leave to their supervisors at least 30 <br /> days in advance of foreseeable events and as soon as possible for unforeseeable events. <br /> Use Time-Off Request and Approval Form 9-10 for this purpose. <br /> A health care provider's statement must be submitted verifying the need for medical leave <br /> and its beginning and expected ending dates. Any changes in this information should be <br /> promptly reported to the General Manager. Employees returning from medical leave must <br /> submit a health care provider's verification of their fitness to return to work. <br /> Eligible employees are normally granted leave for the period of the disability, up to a <br /> maximum of 12 weeks within any 12 month period. Any combination of medical leave and <br /> family leave may not exceed this maximum limit. If the initial period of approved absence <br /> proves insufficient, consideration will be given to a request for an extension. Extensions may <br /> be granted only upon recommendation by the General Manager and by approval of the <br /> Board of Directors. <br /> Employees will be required to use any accrued leave time (such as vacation or sick time) <br /> before taking unpaid medical leave. If an employee has elected to enroll in a short-term <br /> disability insurance policy thorugh payroll deductions, accrued leave time may only be used <br /> to supplement the amount not covered by short term disability payments. Total medical <br /> leave payments paid by disability and/or accrued leave time shall not exceed 100% of <br /> regular pay earnings. <br /> 4-9 10/25/2019 <br />
