I <br /> Special Assessment or other charge levied, assessed or charged by the Association to or against such Unit <br /> which became due prior to the acquisition of title as .a result of• foreclosure or conveyance in lieu .of <br /> foreclosure. Any such unpaid Common Expense Liability, Special Assessment of other charge shall be <br /> deemed a Common Expense for which all Owners, including the mortgagee or other person acquiring title <br /> by foreclosure of a mortgage or deed of trust having priority, or conveyance in lieu of foreclosure, shall <br /> be responsible on an allocated basis as provided herein. <br /> ARTICLE IX <br /> INSURANCE <br /> Section 9.01 OQLvnership of Policies . All insurance policies insuring the Common Elements, <br /> including the Building and the Improvements, shall be purchased by the Association for the benefit of the <br /> Association, the Owners and their respective mortgagees as their interests may appear. Reasonable <br /> provisions shall be made for the issuance of certificates of mortgagee endorsements to the mortgagee of <br /> any Unit. Each &Owner may, at his option, obtain insurance coverage, at his own expense, on his personal <br /> property and such additional liability and/or other coverage as he may desire. <br /> Section 9.02 Coverage. The Building, the Improvements and any and all personal property, if <br /> any, comprising any part of the Common Elements shall be insured by thew Association in an amount <br /> equal to the maximum insurable replacement value thereof as determined annually by the Board of <br /> Directors with the assistance of the insurance company providing such coverage; provided, however, that <br /> the amount of such coverage shall be not less than eighty percent (80%) of the replacement cost of the <br /> Buildings, the Improvements and all personal property comprising any part of the Common Elements. <br /> Such coverage shall provide protection against (a) loss or damage by fire and other hazards covered by a <br /> standard extended coverage endorsement, and (b) such other risks as from time to time shall be <br /> customarily covered with respect to buildings similar m conshuction, • location and use. <br /> Public liability insurance shall be secured by the Association m such amount and with such <br /> coverage as shall be deemed necessary by the Board of Dtirectors, including, but not limited to, an <br /> endorsement to cover liability of the Owners as a group to any single Owner: There shall also be obtained <br /> -48 - <br />
