In the event the Premises are damaged by fire or other casualty, but not wholly destroyed <br /> and/or rendered untenable which fire or casualty occurs after Lessee has exercised its option <br /> to purchase as prescribed in this Section, and. this Lease is not terminated as prescnibed mi <br /> Section 4.05, the contract to purchase and sell as prescribed in this Section is voidable at the <br /> election of Lessee or Lessor and void upon the delivery of written notice prior to Closing to <br /> that effect from the one voiding the contract to the other. <br /> (h) . Upon and after Lessee' s "option to purchase becoming a binding contract between Lessee <br /> and Lessor for the purchase and sale of the Units, Lessor' s reservation of the right as <br /> contained m Section 4.02 and paragraphs 1 and 2 in Article X of the Condominium <br /> Declaration, the present form of which is attached as Exhibit D hereto, to combine, <br /> recombine, subdivide and/or reconfigure either or both of the Units, and/or either or both of <br /> the Units and any Common Elements, shall be exercised by Lessor, if at all, only with the <br /> prior written consent of Lessee. <br /> (i) In the event Lessee shall exercise its option to purchase the Units as provided above, the <br /> closing of the purchase and sale of the Units, including the recordation of the special <br /> warranty deed and the payment of the purchase price (the ' 'Closinn, shall occur not later <br /> than five (5) business days immediately following the date of e�cpiration of the term of this <br /> Lease. <br /> Section 6.15 Recordation.
