25 <br />MOTION: 5trayhorn moved to deny the zoning atlas amendment of areas 3a and 3b. <br />Seconded by Allison. <br />4 Triebel said that he would like to focus on the ?4 people that work at Chandler Concrete and the impact on <br />5 their rights. <br />Woods said that he would like to take this parcel out and approve the rezoning. He would also like to pull <br />out the homeowner that is against the rezoning for her property. <br />l0 Davis said that if it was recommended to deny, it will go on to the Commissioners and the Planning Board <br />11 may not see it again. <br />l2 <br />l3 Schofield said that there was an issue of fairness with Chandler Concrete and the homeowner because the <br />l4 Planning Board has interacted with them. He thinks the issue is the large tract of land across from Hampton <br />15 Pointe. He thinks it would be acting hastily to deny the entire rezoning. <br />16 <br />17 Woods pointed out that Chandler Concrete was on the tail of the proposed area and could be taken out easily. <br />18 <br />19 VOTE: Ayes, 4 (Allison, Strayhorn, McAdams, Gooding-Ray); Noes, 5 (Preston, <br />20 Schofield, Triebel, Woods, Selkirk) <br />21 <br />22 <br />23 The motion failed. <br />z4 <br />25 MOTION: Woods moved to approve the zoning atlas amendment, amending it to <br />26 exclude the 5.8 acres of Chandler Concrete, which is identified by PIN <br />27 number 9873-87-3644. Seconded by Preston. <br />28 <br />29 Schofield made a friendly amendment to instruct the Planning Department to begin immediately the process <br />30 of reviewing the issue ofnon-conforming use that will affect the residential properties in the new zone, in an <br />31 effort to try to achieve some equity for the property owners. Woods concurred with the friendly amendment. <br />32 This was amended to say that the Planning Board would ask the Commissioners to consider a review of the <br />33 non-conforming uses Section of the ordinance. <br />34 <br />35 Chair Gooding-Ray said that she was probably going to vote against this because she thinks it is wrong to <br />36 single out the one homeowner.
