How does this process work? <br />The Orange County Unified Development Ordinance (UDO) requires SUP applications to go before <br />the Board of Adjustment (BOA) for review and decision. Per UDO Sec. 2.7.8, the Board of Adjustment <br />reviews these applications during a public hearing in a “quasi-judicial” format. <br />“Quasi-judicial” means that the board acts much like a panel of judges. The applicant must <br />demonstrate to the board that the project meets all necessary requirements. The board members hear <br />factual evidence and sworn testimony from the applicant and from opposing parties. Only competent, <br />substantial, and material evidence will be considered. In other words, personal opinions not supported <br />by factual evidence will not be heard. The board then decides to approve or deny the application based <br />on evidence submitted during the hearing. <br />Do I have to attend? <br />You are not required to attend this hearing. However, you will need to attend and offer evidence if you <br />wish to support or oppose this application. The hearing is open to the public, but only citizens with <br />“standing” can offer evidence. Again, that evidence must be competent, substantial, and material. <br />Property owners within 1,000 ft. of the club property have standing. <br />Please note that County regulations and State law do not require parties to hire an attorney for the <br />hearing.
