FORCE MAJEURE / DAMAGE OF PREMISES. <br /> (a) Whenever performance by either party of any of their respective <br /> obligations (other than the obligation to make payment of money due hereunder) is <br /> substantially prevented by reason of any act of God, other industrial or transportation <br /> disturbance, fire, floods, riots, acts of enemies, national emergencies or by any other <br /> cause not within the reasonable control of such party and not occasioned by its <br /> negligence, then such performance shall be excused and the performance of such <br /> obligations under this Agreement shall be suspended for the duration of such <br /> prevention and for a reasonable time thereafter. <br /> (b) PROVIDER may terminate this Agreement immediately in the event that <br /> the ORANGE COUNTY's premises are damaged by any casualty, or such portion of <br /> the premises is condemned by any legally constituted authority, such as will make <br /> ORANGE COUNTY's premises unusable for the On-Site Location(s) in the reasonable <br /> judgment of PROVIDER. <br /> 16 <br />
