20 <br /> Certifications and Assurances Fiscal Year 2019 <br /> CATEGORY 14. ALCOHOL AND CONTROLLED SUBSTANCES TESTING. <br /> If the applicant will apply for an award under FTA's Urbanized Area Formula Grants Program <br /> (49 U.S.C. §5307), Fixed Guideway Capital Investment Program (49 U.S.C. §5309), Formula <br /> Grants for Rural Areas Program (49 U.S.C. §5311), or Grants for Buses and Bus Facilities <br /> Program (49 U.S.C. §5339)programs, the applicant must make the following certification. The <br /> applicant must make this certification on its own behalf and on behalf of its subrecipients and <br /> contractors. This certification is required by 49 C.F.R. §655.83. <br /> The applicant certifies that it, its subrecipients, and its contractors are compliant with FTA's <br /> regulation for the Prevention of Alcohol Misuse and Prohibited Drug Use in Transit Operations, <br /> 49 C.F.R. Part 655. <br /> CATEGORY 15. RAIL SAFETY TRAINING AND OVERSIGHT. <br /> If the applicant is a State with at least one rail fixed guideway system, or is a State Safety <br /> Oversight Agency, or operates a rail fixed guideway system, it must make the following <br /> certification. The elements of this certification are required by 49 C.F.R. §§659.43, 672.31, and <br /> 674.39. <br /> The applicant certifies that the rail fixed guideway public transportation system and the State <br /> Safety Oversight Agency for the State are: <br /> (a) Compliant with the requirements of 49 C.F.R.part 659, "Rail Fixed Guideway Systems; <br /> State Safety Oversight"; <br /> (b) Compliant with the requirements of 49 C.F.R.part 672, "Public Transportation Safety <br /> Certification Training Program"; and <br /> (c) Compliant with the requirements of 49 C.F.R.part 674, "Sate Safety Oversight". <br /> CATEGORY 16. DEMAND RESPONSIVE SERVICE. <br /> If the applicant operates demand responsive service and will apply for an award to purchase a <br /> non-rail vehicle that is not accessible within the meaning of 49 C.F.R. Part 37, it must make the <br /> following certification. This certification is required by 49 C.F.R. §37.77. <br /> The applicant certifies that the service it provides to individuals with disabilities is equivalent to <br /> that provided to other persons.A demand responsive system,when viewed in its entirety, is <br /> deemed to provide equivalent service if the service available to individuals with disabilities, <br /> including individuals who use wheelchairs, is provided in the most integrated setting appropriate <br /> to the needs of the individual and is equivalent to the service provided other individuals with <br /> respect to the following service characteristics: <br /> (a) Response time; <br /> 14 <br />
