18 <br /> Certifications and Assurances Fiscal Year 2019 <br /> (a) Has or will have the legal, financial, and technical capacity to carry out its Award, <br /> including the safety and security aspects of that Award, <br /> (b) Has or will have satisfactory continuing control over the use of equipment and facilities <br /> acquired or improved under its Award. <br /> (c) Will maintain equipment and facilities acquired or improved under its Award in <br /> accordance with its transit asset management plan; and <br /> (d) Will comply with 49 U.S.C. §§ 5303 (metropolitan transportation planning) and 5304 <br /> (statewide and nonmetropolitan transportation planning). <br /> CATEGORY 10. GRANTS FOR BUSES AND BUS FACILITIES AND LOW OR NO <br /> EMISSION VEHICLE DEPLOYMENT GRANT PROGRAMS. <br /> If the applicant is in an urbanized area and will apply for an award under subsection (a) <br /> (formula grants) or subsection (b) (competitive grants) of the Grants for Buses and Bus <br /> Facilities Program (49 U.S.C. §5339), the applicant must make the certification in Category 7 <br /> for Urbanized Area Formula Grants (49 U.S.C. §5307). This certification is required by <br /> 49 U.S.C. §5339(a)(3) and(b)(6), respectively. <br /> If the applicant is in a rural area and will apply for an award under subsection (a) (formula <br /> grants) or subsection (b) (competitive grants) of the Grants for Buses and Bus Facilities <br /> Program (49 U.S.C. §5339), the applicant must make the certification in Category 8 for <br /> Formula Grants for Rural Areas (49 U.S.C. §5311). This certification is required by 49 U.S.C. <br /> §5339(a)(3) and(b)(6), respectively. <br /> If the applicant, regardless of whether it is in an urbanized or rural area, will apply for an <br /> award under subsection (c) (low or no emission vehicle grants) of the Grants for Buses and Bus <br /> Facilities Program (49 U.S.C. §5339), the applicant must make the certification in Category 7 <br /> for Urbanized Area Formula Grants (49 U.S.C. §5307). This certification is required by <br /> 49 U.S.C. §5339(c)(3). <br /> Making this certification will incorporate by reference the applicable certifications in <br /> Category 7 or Category 8. <br /> CATEGORY 11. ENHANCED MOBILITY OF SENIORS AND INDIVIDUALS WITH <br /> DISABILITIES PROGRAMS. <br /> If the applicant will apply for an award under the Formula Grants for the Enhanced Mobility of <br /> Seniors and Individuals with Disabilities Program (49 U.S.C. §5310), it must make the <br /> certification in Category 7 for Urbanized Area Formula Grants (49 U.S.C. §5307). This <br /> certification is required by 49 U.S.C. §5310(e)(1). Making this certification will incorporate by <br /> reference the certification in Category 7, except that FTA has determined that(d), (f), (i), 6), and <br /> (k) of Category 7 do not apply to awards made under 49 U.S.C. §5310 and will not be enforced. <br /> 12 <br />
