DocuSign Envelope ID: 12DCC4E1-4D61-4DOE-A2A2-7C6E689613AC <br /> 18 <br /> 6.5 The Contractor shall keep one record copy marked "As-Built" of all Specifications, Drawings, <br /> Addenda, Modifications, and Submittals at the Project in good order and annotated at least <br /> monthly to show all changes made during the construction process. Such monthly annotations <br /> and their approval by the Designer shall be a condition precedent to approval by the Designer of <br /> each monthly Request for Payment. Said record copy shall be stored at the Project and fully <br /> protected from damage by fire or other hazard. This record copy shall be available to the <br /> Designer and Owner for inspection at all times and shall be delivered to the Designer for the <br /> Owner's purposes prior to the Designer's certifying Substantial Completion of the Work. <br /> 6.6 At completion of the Project and before Final Payment, the Contractor shall assemble and <br /> deliver to the Owner one complete set of all as-built drawings and one complete set of all <br /> approved submittals, product data, and samples which were reviewed by the Designer. These <br /> drawings and submittals shall be on paper, or in electronic or other media if required by the <br /> Supplementary Conditions. These drawings and submittals shall be categorized and packaged <br /> as directed by the Designer. <br /> ARTICLE 7. CONTRACTOR <br /> 7.1 The Contractor shall supervise and direct the Work efficiently and with the Contractor's best <br /> skill and attention. Except as may be set forth specifically in the Contract Documents, the <br /> Contractor shall be solely responsible for the means, methods, techniques, sequences, and <br /> procedures of construction, and for safety precautions and programs in connection with the <br /> Work. The Contractor shall be responsible to see that the finished Work complies accurately <br /> with the Contract Documents. <br /> 7.2 The Contractor shall appoint a Project Manager and shall keep on the Project at all times <br /> during its progress a competent Resident Superintendent and necessary assistants who shall <br /> not be replaced without prior written approval by the Owner except under extraordinary <br /> circumstances, in which event immediate written notice shall be given to the Designer and the <br /> Owner. The Project Manager and the Resident Superintendent may be the same person or <br /> different persons. At any time, the Owner, in its sole and absolute discretion, may require the <br /> Contractor to replace the Project Manager or Resident Superintendent with an experienced and <br /> competent person or persons upon seven (7) days written notice from the Owner to the <br /> Contractor. Such replacement shall be at the Contractor's expense and at no cost to the Owner. <br /> Both the Project Manager and the Resident Superintendent shall have authority to act on behalf <br /> of the Contractor, and instructions, directions or notices given to either of them shall be as <br /> binding as if given to the Contractor. <br /> 7.3 The Contractor shall provide sufficient competent and suitably qualified personnel, <br /> equipment, and supplies to lay out the Work and perform construction as required by the <br /> Contract Documents. The Contractor will at all times maintain good discipline and order at the <br /> site, and will comply with all applicable OSHA standards. <br /> Any person employed by the Contractor, any Subcontractor, or any sub-subcontractor who, in <br /> the opinion of the Designer or the Owner, does not perform his Work in a proper and skillful <br /> manner or is intemperate or disorderly shall, at the written request of the Owner or Designer, be <br /> removed forthwith by the Contractor, Subcontractor, or sub-subcontractor employing such <br /> person without cost to the Owner, and shall not be employed again in any portion of the Work <br /> without the written approval of the Owner or Designer. <br /> Revised 12/18 <br />
