44 <br />Mr. Craig Benedict <br />November 17, 2000 <br />Page 2 <br />Consultants. I have attached as Exhibit A to this material the <br />two-page affidavit of Dr. Stewart, along with three pages of <br />documents setting forth his credentials. <br />As Dr. Stewart indicates, the primary source of .the sound from <br />Interstate 40 comes from two separate and distinct directions. One <br />path for sound transmission is found to the south-southeast of the <br />property. I have attached below a photograph taken from the <br />entrance to the proposed development looking to the south--southeast <br />(Fig. 1). As you will note, there is a clear and distinct path <br />directly to I-40. The property ~.n question is not owned by Dr. <br />Diehl, and he does not have any ability to construct any sort of <br />sound-deflecting foliage or berms. Dr. Stewart's report further <br />indicates that the sound originating from this area does not cross <br />or affect the homes to the northeast of the development. Dr. <br />Stewart has also examined, on a broader level, the overall sound <br />transmission for this neighborhood. In doing so, he obtained <br />topographic maps covering a distance of some 4,000 feet in either <br />direction of the proposed subdivision along the I-40 corridor. I <br />have attached copies of those maps to this submission as Exhibit B.' <br />It is apparent that the majority of the sound stems from a region <br />to the west of this subdivision, and that there is absolutely <br />nothing within the boundaries of this subdivision that can be done <br />to affect the transmission of the sound from the source of the I-40 <br />corridor. <br />Entranceway Sound Barriers, Berms, and Additional Plantings. <br />There will be one entrance to the subdivision off of Sunrise Drive, <br />constructed to State specifications . I n o t e h e r e t h a t t h e <br />requirements for a public and a private road are identical, in that <br />a 50-foot-wide easement is required for either type of roadway. <br />The cutting of this roadway will in no way affect the transmission <br />of the sound from this portion of I-40. As reflected on the <br />' revised plans submitted by Mr. Philip Post, my client will be <br />adding plantings along both sides of the entrance to the proposed <br />subdivision (see Sheet C-5, Planting Zones B-1 and B-4). In fact, <br />' the two berms have already been constructed and Leland Cypress are <br />in .place along the tops of both (see Fig. 2). <br />
