DocuSign Envelope ID:2560017F-D6E8-4CA4-8F6F-11521994BEAA <br /> High Performance Building Solutions <br /> Contract Terms for All Scopes <br /> This proposal is valid for 120 days after the issue date on the front page. <br /> Client acknowledges that High Performance Building Solutions cannot commence its work hereunder unless and <br /> until the building is made available. Anything in the Contract Documents to the contrary notwithstanding,the <br /> Client will give the High Performance Building Solutions 14 working days' notice prior to scheduling inspections and <br /> testing. Additional fees may be assessed for rush service with shorter than the specified notice or scheduling task <br /> items outside of normal working hours(Monday through Friday from Sam to 5pm). <br /> The Client shall notify High Performance Building Solutions 5 days prior to a scheduled inspection or test, if the <br /> inspection or test is to be cancelled. Any site visits that are cancelled less than 5 days prior to the scheduled visit <br /> will be subject to additional charges for travel fees incurred. <br /> High Performance Building Solutions will have 10 business days from the testing date to submit all final reports. <br /> High Performance Building Solutions shall not be liable for damages resulting from any delay or default in <br /> performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited <br /> to,Acts of God,Government restrictions,wars, insurrections,and/or the actions of other subcontractors at the <br /> work site. Dates by which testing is scheduled to be met will be extended for a period of time equal to the time <br /> lost due to any delay so caused. <br /> Conditions that would result in additional charges to the Client are: <br /> • Additional Client authorized inspections. <br /> • Additional Air leakage or thermography testing. <br /> • Additional Mobilizations.One mobilization to the project site is included;a fee may be assessed for the <br /> additional travel expenses. <br /> Additional charges will be billed at the following rates: <br /> Senior Engineer/Architectural Engineer: $150/hour <br /> Project Manager: $125/hour <br /> Technician: $85/hour <br /> Mileage: $0.55/mile <br /> Hotel: $120/person-day <br /> Per Diem: $56/person-day <br /> Retest Equipment Fee: $100-$300/day <br /> Additional Travel Fees *Varies by location <br /> *Additional Travel Fees may include, but are not limited to the following: Air Fare, Rental Car, Baggage <br /> Fees,Weekend Rates, etc. <br /> Building Envelope Assessment Proposal <br /> Orange County Government Services Center building, Hillsborough NC Page 9 of 10 <br />
