He also gave an overview of the area. <br /> 31 Tim Smith said they have increased the building setback dimension to 120 feet <br /> 32 along Highway 70. <br /> 33 Tim Smith said they are preserving the 75-foot buffer and existing vegetation along <br /> 34 Highway 70, as well as adding additional plantings to meet the requirements for the Type B <br /> 35 buffer. <br /> 36 Chair Rich asked if the house will be salvaged. <br /> 37 Tim Smith said the house is considerably old, and there is no plan to move it, but it <br /> 38 may be possible to recycle the materials. <br /> 39 Commissioner Dorosin referred to the open spaces, and the path to them on the <br /> 40 perimeter of the land, and asked if it is possible to access the path without walking across <br /> 41 others' properties. <br /> 42 Tim Smith said they will provide access through easements for each lot to access <br /> 43 the open space. He said the intent is for all to have access to all open spaces, and this will <br /> 44 be on the final plan. <br /> 45 Commissioner Marcoplos said there are HOA regulations, and lot maintenance <br /> 46 provisions. He asked if gardens will be allowed under the lot maintenance provisions. <br /> 47 Tim Smith said these are draft items, and he thinks garden will be allowed. <br /> 48 Commissioner Marcoplos said he would also like to include that future HOAs cannot <br /> 49 remove gardens. <br /> 50 Tim Smith said he would refer that to the developer, but he sees no reason why <br /> 51 these conditions would not be accepted. <br />
