DocuSign Envelope ID: F52521E7-10C1-43F9-B62F-C1E599A5D572 <br /> [Departmental Use Only] <br /> TITLE FY19-20_Fence-Stump <br /> FY 19-20 <br /> ORANGE COUNTY <br /> CONTRACT UNDER$5,000.00 <br /> NORTH CAROLINA <br /> THIS AGREEMENT, made and entered into this 23rd day of August, 2019, ("Effective Date") by <br /> and between Orange County, North Carolina, a body politic and corporate organized under the laws of the <br /> State of North Carolina, (the "County"), party of the first part; and Douglas P. Malinowski (the "Provider"), <br /> party of the second part; <br /> WITNESSETH: <br /> For the purpose and subject to the terms and conditions hereinafter set forth, the County hereby <br /> contracts for the services of the Provider, and the Provider agrees to provide the following services to the <br /> County in accordance with the terms of this Agreement,time being of the essence: <br /> The services and/or materials and/or construction (hereinafter referred to collectively as "Services") <br /> to be furnished under this Agreement are as follows: <br /> 1) For the entire extent of the area depicted in WHITE hatching and labeled as "Limits of Stump <br /> Removal' on Attachment A, Provider shall cut and grind existing stumps/shrubs and existing uncut trees to <br /> flush with existing grade. All trimmings shall be chipped and disposed of within the footprint of the stump <br /> removal areas. Install permanent seeding on denuded areas based on in-field direction by the County. <br /> 2) For the 60-ft x 10-ft (600 square foot) area depicted in YELLOW hatching and labeled on <br /> Attachment A, install heavey duty erosion control blanketing and permanent seeding installed per NCDEQ <br /> standards. Erosion control blanketing shall be North American Green RollMax BioNet C70OBN woven <br /> biodegradable coconut fiber matrix erosion control blanket, or approved equal. <br /> 3) Remove approximately 670 LF of existing 5-ft tall chain link fence fabric, top rails, bottom <br /> tension wire, and all associated connection hardware as depicted on Attachment A, remove and legally <br /> dispose off site. This work shall include hand trimming/cutting all existing stumps/shrubs that have grown <br /> into the existing chain link fence fabric. The existing fence posts shall remain in place. Provider shall ensure <br /> that existing fence posts and associated fence post foundations are not damaged or compromised during the <br /> chain link fence removal process. <br /> See Attachment B for detailed quote. See Attachment C for NCDEQ erosion control blanket <br /> installation requirements. See Attachment D for North American Green RollMax BioNet C70OBN erosion <br /> control blanket specifications. See Attachment E for NCDEQ permanent seeding application requirements. <br /> This work must be completed no later than September 30, 2019. Work completion date is subject to <br /> modification upon 15 days advanced written notice to Provider by County. <br /> The term of this agreement rendered shall be from August 23,2019 to September 30,2019. <br /> Provider represents and agrees that Provider is qualified to perform and fully capable of performing and <br /> providing the services required or necessary under this Agreement in a fully competent, professional and <br /> timely manner to the satisfaction of the County. Provider shall be responsible for all errors or omissions, in <br /> the performance of the Agreement. Provider shall correct any and all errors, omissions, discrepancies, <br /> ambiguities, mistakes or conflicts at no additional cost to the County. Provider agrees that Provider shall not <br /> sub-contract any of the services to be provided in this Agreement, nor shall Provider assign any right or <br /> responsibility granted or required by this Agreement,without the prior written approval of the County. <br /> SPECIFIC TERMS <br /> 1. Payment: The County agrees to pay at the rates specified for Services satisfactorily <br /> performed in accord with this Agreement. The amount to be paid by the County shall not exceed THREE <br /> THOUSAND ONE HUNDRED TWENTY FIVE DOLLARS, ($3,125.00). Payment shall be made within <br /> Revised 12/18 1 <br />
