NORTH CAROLINA <br />CONTRACT AMENDMENT <br />ORANGE COUNTY <br />THIS CONTRACT AMENDMENT (“Amendment”) is made and entered into this 9th day of August, 2019 by and <br />between ORANGE COUNTY (hereinafter referred to as “County”) and Moseley Architects, P.C.(hereinafter referred <br />to as “Provider”). <br />WITNESSETH: <br />THAT WHEREAS, the County and Provider entered into a contract dated August 24, 2015, (hereinafter the “Original <br />Agreement”), for the provision of consulting services for the design of the Orange County Detention Center; and <br />WHEREAS, the County and Provider amended the Original Agreement on March 27, 2019, expanding the scope of <br />services to consist of designing the roof structure and electrical infrastructure to be PV-ready. <br />NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to <br />amend the Original Agreement as follows: <br />1. In order to ensure the completion of the services, the maximum amount payable of the Original Agreement is <br />amended to increase the amount payable to Provider by sixty one thousand six hundred forty three dollars <br />($61,643) to reflect an amount not to exceed of one million seven hundred seventy two thousand eight <br />hundred thirty six dollars ($1,772,836), described according to the attached proposal titled “Orange County <br />Amendment Number 005” and dated June 26, 2019. <br />2. Geothermal Heating and Cooling – design of a geothermal heating & cooling system including coordination <br />for test well, evaluation of location and extent of well field, coordination with others, local government <br />coordination for Site Plan approval, and depiction of system components on civil plans as needed. <br />3. Detailed analysis of vehicular trip generation for the Project as requested by NCDOT, and subsequent <br />coordination with NCDOT related thereto. <br />4. Services related to the inadequacy of the Town of Hillsborough’s water system for water service to the <br />Project; including coordination with Town staff for a second water system flow test, re-evaluation and re- <br />modeling of several options to meet pressure and flow requirements including using various pumping <br />systems and water system configurations, related coordination with Town Utilities staff, and making <br />inquiries with the Town and their consultant about modifying Town pumps to allow for dual pumping for <br />refilling the Town water tank that serves the site (see exclusions below). <br />5. Additional design, permitting, construction observation, and closeout work related to having three onsite <br />water system networks instead of a single one, due to the Town water system deficiencies and changed <br />policies. <br />6. Work related to supporting the Fire Pump and Pump House being designed by others, including placement <br />and configuration on the site, landscape screening, surface drainage, coordination related to electrical service, <br />local Site Plan approval, local construction drawing approval, and water system extension permit from State <br />agencies. <br />DocuSign Envelope ID: B59D5822-336E-40C5-911A-8FC53B025BA8
