1'~ <br />4 <br />7. Prior to any deve/opmenf or disfurbance an the site, a modification to <br />the Class A Special Use Permit must be submitted for final <br />development plan approval which will include the final site <br />development plan. Compliance with agency comments will be <br />reviewed for each Parcel to be developed. <br />$. An Access Management System shall be instituted on Strouds Creek <br />Road with full median openings every 660 feet and right in and right <br />out maximum every 330 feet. <br />9. No open burning is allowed. <br />1 D. All drive-in and drive-through Restaurants are prohibited. <br />11. If any candition of this Special Use Permit shall be held invalid or <br />vaid, then this Special Use Permit shall be void in ifs entirety and of <br />no effect. <br />No decision on the application is made by either the Planning Board or <br />the Board of Commissioners at the public hearing. Instead, the Planning <br />Board has 3 regularly scheduled meetings within which to prepare and <br />submit a recommendation to the Board of Commissioners or the Board of <br />Commissioners may direct the Planning Board to provide a <br />recommendation by a date certain. Failure of the Planning Board to <br />submit a recommendation within the required time, the application shall <br />be forwarded to the Board of Commissioners without a Planning Board <br />recommendation. <br />Administration Recommendation <br />The Administration recommends that the application be referred to the <br />Planning~8oard for a recommendation to be returned to the Board of <br />Commissioners no sooner than May 15, 2001. <br />
