~.~ ~ 1 <br />3 <br />The Zoning Officer has reviewed the applicatian, the site plan and all <br />supporting documentation and has found that the application does comply <br />with the specific standards and required regulations concerning the <br />Rezoning, Planned Development and Special Use Permit. <br />Provided the Planning Board and County Commissioners find in the <br />affirmative on the general standards, the Zoning Officer recommends <br />approval of the request for a Rezoning, Planned Development, and <br />Special Use Permit for The Preserve subject to the following conditions: <br />1. Existing and proposed vegetation shall be installed and/or <br />maintained as indicated on the Landscape plan. <br />2. The submitted draft homeowners association documents and <br />restrictive covenants to address use and maintenance of the <br />recreation and open space areas shall be reviewed and approved by <br />the County Attorney. <br />3. Security shall be submitted by the applicant and approved by the <br />County Attorney guaranteeing the construction of all improvements. <br />Security may be posted on a Phase by Phase basis however, all <br />improvements in each phase must be completed before construction <br />may begin on a new phase. The amount of the security shall be 110 <br />percent of the estimate. <br />4. Water and Sewer improvements shall be constructed to Town of <br />Hillsborough standards. <br />5. ,All road improvements shall be constructed to NCDOT standards. <br />a. Improvements proposed for NC 57 shall include widening the <br />pavement to form a right turn lane 280 feet from the NC86 <br />intersection with a 150 foot taper. <br />b. Improvements proposed on US 70 Bypass shall include a 300 <br />foot full right turn lane with a 150 foot taper. <br />c. Improvements proposed on the NC 86 south bound lane shall <br />include a full 180 foot straight lane with a 100 foof taper. <br />d. Improvements to the north bound right turn lane on NC 86 shall <br />include a full 200 foot lane with a 150 foot taper. <br />e. Additional 2 lanes with divided road on north side of Strouds <br />Creek Road. <br />f. Design, purchase, and construct a 4 lane section of Strouds <br />Creek Road to NC 86. <br />6. The Special Use Permit will automatically expire within 12 months <br />from the date of approval if the use has not commenced or <br />construction has not commenced or proceeded unless a timely <br />application for extension of this time limit is approved by the Board of <br />County Commissioners as provided in section 8.4.11 of the Orange <br />/1_..~1. _ 7-._.._ n I <br />
