., ... <br />~f,, ~lliC-~ J~/.~ <br />~~,~ ; <br />~E JoxN R ~~~~s co~~ arc. <br />-In anticipation of the proposed development over 18 acres have <br />already been deeded to the Orange County Board of Education <br />and is being used for the construction of Pathway School. <br />As required by the Orange County Zoning Ordinance, a Special Use Permit is <br />applied for concurrent with the rezoning request for approval of the proposed PD- <br />MU Master Plan. If approved, the Master Plan will allow future development <br />applications (individual Special Use Permits and Subdivisions) to proceed for the <br />various land uses designated within each of the plan's development parcels. <br />As proposed, the Master Plan meets the required Special Use Permit findings as <br />follows: <br />1. The use will maintain or promote the public health, safely, and general <br />welfare, if located K~Izere proposed and developed and operated <br />according to the plan as submitted: <br />The master plan is designed to meet, and in some instances exceed, <br />Orange County's development regulations. All land use intensity <br />requirements will be met; approximately SO% of the site has been or will <br />be dedicated to the County or preserved as open space and recreation <br />areas; streams will be buffered with natural woodlands; and vegetated <br />buffers will be provided along the development's perimeter. <br />In an effort to enhance County services, a school site already has been <br />dedicated to the County Board of Education and the Master Plan includes <br />a site for County facilities adjacent to the Town Center. Additionally, the <br />developer is participating in the cost of infrastructure to serve the school <br />and will provide the infrastructure necessary to support the proposed <br />County facilities site. <br />The proposed development is strategically located with access to major <br />thoroughfares, including Western Bypass. As detailed above, the <br />developer proposes to construct several improvements at the intersections <br />of NC 86 and NC S7 and NC 86 and US 70 in order to further facilitate <br />the flow of vehicle traffic to and from the site. <br />Z. The use will maintain or enhance the value of contiguous property (unless <br />the use is a public necessity,, in which case the use need not maintain or <br />enhance the value of cvntiguous property); <br />It is anticipated that the proposed development will enhance the value of <br />contiguous property. As detailed in. this statement, the project was <br />designed to meet or exceed all applicable land use regulations and <br />policies. Further, the project is a master planned community with <br />restrictions that control the quality of development. <br />Anaw 1 <br />
