~I~ <br />simultaneously approves the Special Use Permit, Class A application for <br />the development of the property, .which special use permit may be <br />approved subject to reasonable conditions and requirements as set forth in <br />Article 8 of the Zoning Ordinance and the guidelines in Article 6.29.3 of the <br />Zoning Ordinance. <br />4. In addition to other grounds for denial of a special use permit application, a <br />special use permit may be denied on the basis that the application is <br />inconsistent with an approved Master Development Plan far the same tract. <br />However, if the special use permit is approved, the Board of County <br />Commissioners shall be deemed to have amended the Master <br />Development Plan to the extent necessary to bring it into conformity with <br />the existing project Special Use Permit, Class A. <br />E. Final Development Plan Provisions <br />1. Site Plans drawings for Final Development Plans shall meet the <br />requirements of Article 14 of the Zoning Ordinance and shall be consistent <br />with the approved Master Development Plan and address all conditions of <br />the project Special Use Permit, Class A. <br />2. Tracts over 2.0 acres and/or structure(s) totaling cumulatively over 20,000 <br />square feet on one zoning lot shall submit a Special Use Permit, Class A <br />modification request for a Public Hearing and follow all procedures as <br />specified in the zoning ordinance. Otherwise, the site plan may be <br />approved by the Planning Director. <br />3. A metes and bounds legal description of the Final Development Plan shall <br />be submitted along with either the application for the Special Use Permit, <br />Class A modification or the site plan submitted for Planning Director <br />approval. <br />4. No special use permit for a site governed by a Master Development Plan <br />may be denied for reasons set Earth in Article 8 (Special Uses) if the basis <br />for such denial involves an element or effect of the development that has <br />previously been specifically addressed and approved in , the Master <br />Development Plan approval process, unless (i) it can be demonstrated that <br />the information presented to the Board of County Commissioners at the <br />Master Development Plan approval stage was materially false or <br />misleading, or (ii) conditions have changed substantially in a manner that <br />could not reasonably have been anticipated, or (iii) a basis for denial for <br />reasons set forth in Article 8 (Special Uses) is demonstrated by clear and <br />convincing evidence. <br />5. No Final Development Plan shall be accepted by staff for review until the <br />Master Development Plan has been approved and recorded. <br />6. The Planning Director shall have the discretion to require that a site plan <br />follow the public hearing Special Use Permit modification procedures <br />
