<br /> <br />Page 4 of 5 <br /> <br />e. EENP shall also ensure Adele is in good health, fully vaccinated, and free of <br />any known disease or defects. Further, EENP shall provide a one year (12 <br />month) warranty from the date of sale against any genetic defects or medical <br />issues, unrelated to the lead handler’s care of the dog, which may render her <br />unfit as a facility dog. <br />f. EENP will not require the Parties to participate in fund raising or public <br />relations activities. <br />g. To the extent authorized by North Carolina law and only up to the applicable <br />insurance policy limits, EENP, its officers, employees, agents and directors, <br />are released from any liability for injury, damage, harm or expense that might <br />incur from the Facility Dog. <br />h. At the request of the current owner, EENP will assume ownership and care of <br />Adele at any time after placement if the County, the lead handler, or any <br />future owner is unable or unwilling to care for her for any reason. <br />5. THIRD PARTY RIGHTS <br />Nothing in this Agreement is intended to create, grant, or convey rights in or to any <br />third party. Nothing herein is enforceable by any third party and the rights of the <br />parties hereto to terminate or amend this Agreement are not subject to the consent <br />of any third party. <br />6. RETIREMENT <br />a. It is expected Adele shall be capable of providing the services described <br />herein for a period of between four and eight years. <br />b. At the conclusion of the services provided herein and upon a determination by <br />EENP and the County that Adele is no longer capable of providing the services <br />described herein due to age or sickness, the County Manager may make a <br />determination that Adele is no longer in governmental use and has no financial <br />value. Upon any such determination ownership, custody, and control shall be <br />granted to Regina Miller. <br />7.
