8 <br />provided that the purpose is not otherwise described in subsections (a)(1) through (4) of this <br />definition and the purpose is permitted by Applicable Law, including but not limited to the <br />HIPAA regulations; <br />6. Research purposes as permitted by Applicable Law and the NC HIEA Policies (please note <br />that is not a Permitted Purpose for Transacting Message Content through the eHealth <br />Exchange); <br />7. To carry out Benefits Determinations; and <br />8. Uses and disclosures pursuant to an Authorization provided by the individual who is the <br />subject of the Message or such individual’s personal representative as described in 45 C.F.R. <br />§164.502(g) of the HIPAA Regulations. <br />EAs to NC HIEA, Permitted Purposes shall mean one of the following reasons for which NC <br />HIEA maylegitimatelyexchangeHIEData,TransactMessageContent,orotherwiseuse,access, <br />or disclose HIE Data: <br />HIE Operations; <br />Public health activities and reporting as permitted by Applicable Law, including N.C.G.S. <br />§90-414.1 et seq., Chapter 130A and the HIPAA Regulations at 45 C.F.R. § 164.512(b) or <br />164.514(e); <br />Health Care Operations; <br />Benefits Determinations for Individuals who apply for or do receive services from State <br />funded programs; <br />Activities to support data aggregation and analytics as set forth in 45 § C.F.R. 164.504(e), <br />1C.S.L. 2015-264 Section 86.5.(a), and other Applicable Law; <br />Research purposes as permitted by Applicable Law and the NC HIEA Policies and <br />Procedures; <br />Activities required by Applicable Law; and <br />Support of the Permitted Purposes of Participants and Approved Third Parties. <br />FAs to Approved Third Parties, Permitted Purposes shall mean one of the following reasons for <br />which Approved Third Parties may legitimately exchange HIE Data, Transact Message Content, <br />or otherwise use, access, or disclose HIE Data: <br />If Transacted through the eHealth Exchange or another nationwide or regional network, for <br />all Permitted Purposes listed in subsection (a) of this Section with the exception of any <br />purpose excluded by the relevant nationwide or regional network governance body or <br />agreement (e.g., See Attachment 9); <br />Public health activities and reporting as permitted by Applicable Law, including N.C.G.S. <br />§90-414.5, Chapter 130A and the HIPAA Regulations at 45 C.F.R. § 164.512(b) or <br />164.514(e); <br />Research purposes as permitted by Applicable Law and the NC HIEA Policies and <br />Procedures; and <br />Activities SHUPLWWHGRUrequired by Applicable LawLQFOXGLQJ1&*6†† D DQG <br /> <br />GPursuant to N.C.G.S. § 90-414.6, no entitymayuse, disclose, oraccess HIE Data for commercial <br />purposes. <br />DocuSign Envelope ID: 47B4445A-C7CA-4D2E-9075-2AFD82F82DEC
