8 <br /> As a general reminder, the Resolution of Approval contains declarations and conditions of <br /> approval associated with this project. Said conditions are tied to specific subdivision <br /> requirements, as articulated within the UDO, or are directly associated with an applicant's <br /> proposal/design (i.e. percentage of open space, setbacks, minimum to maximum lot size, <br /> passive recreation areas, etc.). These conditions apply to this specific request based on the <br /> requirements of the UDO for major subdivision projects not exceeding 20 proposed lots. These <br /> `conditions' are an attempt to memorialize applicable development standards as they relate to <br /> the project and the enforcement of the UDO. The imposition of these `conditions' should not be <br /> confused with actions the County can take for Conditional Zoning or Special Use Permit <br /> applications, which potentially have broader discretion and scope. <br /> As this project represents a regulated 'by right' subdivision, the applicant can only be held to the <br /> standards contained within the UDO, specifically the provisions of Section 2.15 Major <br /> Subdivisions and Article 7 Subdivisions. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to <br /> this item: <br /> • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND <br /> ENVIRONMENTAL POLICIES <br /> The fair treatment and meaningful involvement of people of all races, cultures, incomes <br /> and educational levels with respect to the development and enforcement of <br /> environmental laws, regulations, policies, and decisions. Fair treatment means that no <br /> group of people should bear a disproportionate share of the negative environmental <br /> consequences resulting from industrial, governmental and commercial operations or <br /> policies. <br /> FINANCIAL IMPACT: Staff has determined the project would not require augmentation of <br /> County budgetary outlays to support services and that anticipated revenues from property taxes <br /> should supplement increases in cost. <br /> RECOMMENDATION: The Manager recommends the Board: <br /> 1. Receive the Planning Board and Planning Director's recommendations on the <br /> Preliminary Plat application for the Fairway Hills Subdivision, <br /> 2. Discuss the proposal as desired, and <br /> 3. Approve the Preliminary Plat and Resolution of Approval contained in Attachment 7. <br />
