15 <br /> Association for, without limitation, (i) the costs of any capital improvement to any Common <br /> Elements,and/or(ii)any extraordinary cost or expense incurred by the Association. <br /> (ee) "Street" shall mean any part of the Property identified and described as a <br /> street,road or cul-de-sac on the Subdivision Plat. <br /> (ff) "Subdivision Plat" shall mean that certain plat of survey recorded by <br /> Declarant in the office of the Register of Deeds of Orange County, North Carolina in Plat Book <br /> Pages through , as amended, modified and/or supplemented by any Supplemental <br /> Plat(as hereinafter defined). <br /> (gg) "Supplemental Declaration" shall mean any document executed by <br /> Declarant during the Period of Declarant Control or,thereafter,by the Association,and recorded in <br /> the office of the Register of Deeds of Orange County,North Carolina for the purpose(s)of,without <br /> limitation, (i) amending, modifying and/or supplementing any provision contained in this <br /> Declaration, and/or (ii) subjecting Additional Property, including any Lot(s), Common Elements <br /> and/or Street(s) subdivided therefrom, to the provisions of this Declaration as provided in Section <br /> 2.02. <br /> (hh) "Supplemental Plat" shall mean any plat of survey prepared by Declarant <br /> during the Period of Declarant Control or,thereafter, by the Association and each affected Owner, <br /> if any, in the office of the Register of Deeds of Orange County, North Carolina for the purpose(s) <br /> of, without limitation, (i) subdividing, re-configuring, combining, re-combining, consolidating, <br /> removing and/or renumbering any Lot(s), Common Elements and/or Street(s), or any combination <br /> thereof; (ii) adding Additional Property, including any Lot(s), Common Elements and/or Street(s) <br /> subdivided therefrom,to the Community as provided in Section 2.02; and/or(iii)adding,removing <br /> and/or relocating any Trail(s)on any Lot(s)and/or Common Elements. <br /> (ii) "Trail" shall mean any part of any Lot and/or Common Elements <br /> designated as a "Trail" on the Subdivision Plat. Each Trail shall include all of the applicable <br /> easement area described in Section 3.05. <br /> Section 1.02 Rules of Construction. <br /> (a) Gender. When and as used in this Declaration, words of the masculine <br /> gender shall be deemed and construed to include co-relative words of the feminine and neuter <br /> genders and words of the neuter gender shall be construed to include co-relative words of masculine <br /> and feminine genders. <br /> (b) Ca tp ions. The captions or headings in this Declaration are for <br /> convenience only and in no way define, limit or describe the scope or intent of any provision of this <br /> Declaration. <br /> (c) Reference. All references in this Declaration to particular Articles, <br /> Sections or paragraphs are references to Articles, Sections or paragraphs of this Declaration unless <br /> some other reference is established. <br /> 5 <br />
