11 <br /> DECLARATION OF COVENANTS,CONDITIONS, <br /> RESTRICTIONS AND EASEMENTS <br /> FOR <br /> E <br /> THIS DECLARATION OF COVENANTS, CONDITIONS,RESTRICTIONS AND <br /> EASEMENTS FOR ("Declaration") is made and executed effective as of the <br /> day of , 2019, by , a North Carolina limited <br /> liability company, 504 Meadowlands Drive,Hillsborough,North Carolina 27278("Declarant"). <br /> Recitals <br /> Declarant has acquired the Property (as hereinafter defined) which is located in Orange <br /> County,North Carolina. <br /> Declarant intends to improve and develop the Property as a residential planned <br /> community to be known as IP�W" by subdividing the Property into Lots (as hereinafter <br /> defined) for detached single family residential buildings and Common Elements (as hereinafter <br /> defined) for the common use and enjoyment of the owners of the Lots and their respective family <br /> members,guests,tenants and/or invitees. <br /> In furtherance of its development of the Property as a residential planned community, <br /> Declarant intends to subject the Property to all of the covenants, conditions, restrictions, <br /> easements, liens, charges, assessments and equitable servitudes set forth in this Declaration for <br /> the benefit of the Community (as hereinafter defined), the owners of Lots and their respective <br /> family members,guests,tenants and/or invitees,and the Association(as hereinafter defined). <br /> The recording of the Subdivision Plat(as hereinafter defined) and this Declaration in the <br /> office of the Register of Deeds of Orange County, North Carolina, will create a residential <br /> planned community upon the Property pursuant to the provisions of the Act (as hereinafter <br /> defined). <br /> NOW, THEREFORE, subject to the rights of Declarant established and/or reserved <br /> herein, Declarant hereby declares that all of the Property, including each Lot and all Common <br /> Elements, shall be hereafter owned, held, occupied, improved, used, mortgaged, transferred, sold, <br /> leased, rented and/or conveyed subject to and in accordance with all of the covenants, conditions, <br /> restrictions, easements, liens, charges, assessments and equitable servitudes set forth in this <br /> Declaration to the extent not inconsistent with the provisions of the Act and/or other applicable law. <br /> The purpose of this Declaration shall be to enhance and protect the value, use, enjoyment and <br /> desirability of the Property. This Declaration and all of the covenants, conditions, restrictions, <br /> easements, liens, charges, assessments and equitable servitudes set forth herein shall run with the <br /> Property, including each Lot and all Common Elements, and shall be binding upon and inure to <br /> the use, benefit and enjoyment of each Person (as hereinafter defined) having any right, title <br /> and/or interest in or to the Property, including Declarant, each owner of a Lot, the Association <br /> and their respective heirs, successors and/or assigns. <br /> 1 <br />
