The owner has since submitted the required zoning atlas <br /> application seeking to proceed with a rezoning eliminating the existing split zoning of the <br /> property zoning the entire parcel EC-5. This is consistent with what staff originally proposed in <br /> 2016. <br /> It is unclear why the original zoning effort undertaken in the Bingham Township, which occurred <br /> in 1981, failed to capture the various non-residential land uses that were in existence on the <br /> property. As previously indicated, maps and survey <br /> denoting the subject property are contained within Attachments 2 and 3. <br /> Public Notifications: In accordance with Section 2.8.7 of the UDO, letter notices of the rezoning <br /> and the time location and nature upcoming Planning Board meeting were mailed to residents <br /> with 1,000 feet of the subject parcel. A sign indicating the rezoning request and Planning Board <br /> meeting was also posted on the property. <br /> JPA Review: This request is located within the Rural Buffer (RB) zoning district and within the <br /> Joint Planning Area (JPA) with Carrboro. In accordance with the provisions of the JPA, the <br /> Town of Carrboro was notified of this request on April 11, 2019. As of April 23, 2019, no <br /> comments have been received from the town. <br /> Planning Director's Recommendation: The Planning Director recommends approval of the <br /> Statement of Consistency, indicating the amendments are reasonable and in the public interest, <br /> contained in Attachment 4 and the proposed zoning atlas amendment ordinance contained in <br /> Attachment 5. <br /> The proposed atlas amendment addresses non-conformities associated with the existing land <br /> uses on property by extending the EC-5 zoning designation over the entire parcel. Further <br /> development/redevelopment of the property will need to abide by applicable development <br /> standards including required land use buffers and impervious surface limits. <br /> FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding <br /> for the provision of County services.
