Cancellation is deleted in its entirety and replaced by the <br /> following: <br /> 6. Cancellation and Nonrenewal. <br /> I. Cancellation. <br /> (a) The first Named Insured shown in the Declarations may cancel this policy by mailing or <br /> delivering to us advance written notice of cancellation. <br /> (b) If this policy has been in effect for less than sixty (60) days, we may cancel this policy for any <br /> reason by mailing or delivering to the first Named Insured written notice of cancellation, at least <br /> fifteen(15)days before the effective date of cancellation. <br /> (c) If this policy has been in effect for sixty(60)days or more or after the effective date of a renewal <br /> by us of this policy,we may cancel only for one or more of the following reasons: <br /> (1) Nonpayment of premium; <br /> (2) An act or omission that constitutes material misrepresentation or nondisclosure of a material <br /> fact made by you or your representative in obtaining the policy, continuing the policy or in <br /> presenting a claim under the policy; <br /> (3) Substantial breach of contractual duties, conditions or warranties that materially affects the <br /> insurability of the risk; <br /> (4) Increased hazard or material change in the risk assumed that could not have been <br /> reasonably contemplated at the time of assumption of the risk; <br /> (5) Determination by the Commissioner of Insurance that continuation of coverage would place <br /> us in violation of the laws of North Carolina; <br /> (6) A fraudulent act against us by an insured or his or her representative that materially affects <br /> the insurability of the risk; <br /> (7) Willful failure by an insured or his or her representative to institute reasonable loss control <br /> measures that materially affect the insurability of the risk after written notice by us; <br /> (8) Loss of facultative reinsurance, or loss of or substantial changes in applicable reinsurance <br /> as provided in G.S. 58-41-30; or <br /> (9) Conviction of an Insured of a crime arising out of acts that materially affect the insurability <br /> of the risk. <br /> (d) We will mail or deliver written notice, including the reason for cancellation,by first class mail to <br /> the first Named Insured at the last mailing address known to us at least fifteen(15) days before its <br /> effective date. Proof of mailing shall be sufficient proof of notice. <br /> (e) Cancellation for nonpayment of premium will not become effective if you pay the premium amount <br /> due before the effective date of cancellation.
