DocuSign Envelope ID: D9F8096F-FD8F-4DEF-97BC-32AEDC1721F9 <br /> EXPANDED CONTRACTUAL LIABILITY ENDORSEMENT <br /> In consideration of the premium, it is agreed that the policy definition of Insured contract is deleted and replaced by the <br /> following: <br /> Insured contract means: <br /> (a) A hold harmless agreement required by a military or governmental authority as a prerequisite to the use of an <br /> airport,heliport or a related facility; <br /> (b) A written contract for the temporary storage or minor servicing of a scheduled aircraft or non-owned aircraft; <br /> (c) That part of any other written contract or agreement pertaining to a scheduled aircraft, non-owned aircraft, <br /> or airport premises (including an indemnification of a municipality in connection with work performed for a <br /> municipality)under which you assume the liability of another party to pay for bodily injury or property damage <br /> to a third person or organization, provided that you submit a copy of any such contract or agreement to the <br /> Policy Issuing Office shown in the Declarations within thirty (30) days of coming to your attention or that of <br /> your Insurance Department, if any. We reserve the right to charge an additional premium for any such contract or <br /> agreement. We waive the submission requirement as respects agreements we have approved prior to the effective <br /> date of this policy. <br /> However, an insured contract does not include that part of any contract or agreement described in this paragraph: <br /> (1) That is with or for the benefit of any person who is in, on or boarding an aircraft for the purpose of riding or <br /> flying therein,or alighting therefrom after a ride,flight or attempted flight therein,or any such person's heirs; <br /> (2) That pertains to the purchase or sale of aircraft; <br /> (3) That indemnifies any person or organization, or any agent or employee thereof, engaged in: <br /> a. The design or manufacture of aircraft or aircraft parts, or <br /> b. Making "major alterations" or "major repairs," as those terms are defined in the Federal Aviation <br /> Regulations of the United States, to aircraft, for bodily injury or property damage caused by an <br /> occurrence arising out of such activity; <br /> (4) That indemnifies a railroad for bodily injury or property damage arising out of construction or demolition <br /> operations within fifty (50) feet of any railroad property and affecting any railroad bridge or trestle, tracks, <br /> roadbeds,tunnel,underpass or crossing; <br /> (5) That indemnifies an architect, engineer or surveyor for bodily injury or property damage arising out of: <br /> a. Preparing,approving, or failing to prepare or approve,maps, shop drawings, opinions,reports, surveys, <br /> field orders, change orders or drawings and specifications, or <br /> b.
