Article 5 : Uses <br /> Section 5 . 11 : Standards for Waste Management Facilities <br /> (3) Facilities have been located , constructed , or modified without first IN <br /> btaining , or in <br /> a manner not authorized by , the required Special Use Permit , MlInLe <br /> ny other <br /> necessary authorization and the Special Use Permit may be r ed <br /> ( C) If the C my makes such a determination as noted above , then th County shall notify the <br /> holder of e Special Use Permit for the facility within 48 hours It It said facility shall be <br /> removed . <br /> ( D ) The holder of It Special Use Permit , or its successors o ssigns , shall dismantle and <br /> remove such facile , and all associated structures , fro he site and restore the site to as <br /> close to its original c dition as is possible , such re ration being limited only by physical <br /> or commercial impracti bility, within 90 days of r eipt of written notice from the County . <br /> However , if the owner of e property upon whi the facility are located wishes to retain <br /> any access to the facility , th owner may do with the approval of the County . <br /> ( E) If a facility is not removed or su tantial ogress has not been made to remove the <br /> facilities within 90 days after the p rm ' older has received notice , then the County may <br /> order officials or representatives of e County to remove the facility at the sole expense of <br /> the owner or Special Use Permit old <br /> ( F) If the County removes , or ca es to be re oved a facility , and the facility owner does not <br /> claim and remove it from t site to a lawful cation within ten days , then the County may <br /> take steps to declare th acility abandoned , a sell them and their components . <br /> ( G ) Temporary Use Per it/Agreement <br /> ( 1 ) Notwit tanding anything in this Section to Itcontrary , the County may approve <br /> a to porary use permit/agreement for the facili , for no more than 90 days , <br /> d ing which time the holder of the Special Use rmit shall develop a suitable <br /> Ian for facility removal , conversion , or re - location , bject to the approval of the <br /> County , and the holder of the Special Use Permit and e County shall execute <br /> an agreement to such plan . <br /> (2) If such a plan is not developed , approved and executed wit the 90 day time <br /> period , then the County may take possession of and dispose o the affected <br /> facility in the manner provided in this Section and utilize the bon <br /> 5 . 10 . 10 Ham Radio Antenna 194 <br /> ( A) Standards of Evaluation <br /> ( 1 ) Shall be for the private use of the property owner on which they are located . <br /> ( 2 ) Shall not exceed 90 ft . in height .
