Article 5: Uses <br /> Section 5.4: Standards for Temporary Uses <br /> <br /> <br /> <br />Orange County, North Carolina – Unified Development Ordinance Page 5-42 <br /> <br />(1) Yard sales are permitted in accordance with the Table of Permitted Uses <br />provided that these sales do not exceed two days per month. <br />5.4.2 Temporary Fund Raising Activity <br />(A) General Standards for of Evaluation <br />(1) Temporary fund raising activities are permitted in accordance with the Table of <br />Permitted Uses provided that these activities do not exceed two days per month. <br />5.4.3 Special Events <br />(A) Use Standards149 <br />(1) Standards for all Special Events <br />(a) Shall not occur more than seven days in a 30-day period or more than 50 <br />days per year.150 <br />(1)(2) Arts and Cultural Special Events <br />(a) All arts and cultural special events organized, conducted, and affiliated <br />with a 501(c)(3) nonprofit organization or government entity, for example <br />the annual Orange County Open Studio Tour, shall be exempt from the <br />special event review and permitting process. <br />(B) General Standards of EvaluationSubmittal Requirements <br />(1) The application shall include: <br />(a) A plot plan, drawn to scale, showing the boundaries of the area to be <br />used for the events, the locations of access points, parking, service <br />areas, activity areas, restrooms, solid waste disposal/recycling <br />facilities, lighting, and signage;151 <br />(b) aA written description of the type of event planned, the number of <br />participants for any single event, the frequency of the events, the <br />anticipated hours of operation, the potential dates for the events, and the <br />method and adequacy of sewage disposal, recycling and waste disposal, <br />access, parking, lighting, and signage; <br />(c) Written comments from the Orange County Health Department, <br />Division of Environmental Health regarding the adequacy of plans <br />restroom facilities and food preparation/handling arrangements; <br />and151 <br />(a)(d) Written comments from the Orange County Fire Marshal and <br />Sheriff’s Department regarding the adequacy of parking, access, or <br />other factors related to public safety. 151 <br />(2) The plot plan shall be accompanied by written approval from the Orange County <br />Division of Environmental Health regarding the adequacy of the water-supply and <br />wastewater disposal; <br />(3) The plot plan shall have written approval from the Orange County Fire Marshal; <br /> <br />149 Consistent with advice from the County ‘s Attorney office we are creating/identifying a general ‘use standards’ <br />section for various land uses. This was predicated on limiting the use of symbols in the table of permitted uses to <br />only signifying review processes. Currently, the table utilizes symbols to identify development opportunities and <br />constraints. These regulations and allowances are now being moved to the various impacted land use standards in <br />Article 5. <br />150 3/5/2019 ‐ This is existing language from the definition of a ‘Special Event’ in Article 10.
